Mashpee Zoning <br />Board of Appeals Minutes <br />• 2 August 13, 2008 <br />Evan and Susan Dangel: Request a Variance from Section 174-33 of the <br />Zoning By-laws to seek relief from the setback requirments from the distance to <br />the wetlands (50' required) in order to build a new dwelling on property located <br />in an R-5 zoning district at 762 Cotuit Road (Map 3 Parcel 14) Mashpee, MA. <br />Evan and Susan Danqel: Request a Special Permit from Sections 174-17 and <br />174-20 of the Zoning By-laws in order to raze and replace a pre-existing non- <br />conforming structure on property located in an R-5 zoning district at 762 Cotuit <br />Road (Map 3 Parcel 14) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, James Reiffarth and Jack <br />Dorsey. <br />John Slavinsky of Cape & Islands Engineering represents the applicants at this hearing. <br />This matter was continued from July 9, 2008 due to conservation issues. They are <br />seeking to raze and replace the dwelling and they also need a variance to the wetlands <br />setback requirements. The existing house sits at 19 feet from the wetlands, the new <br />house will be at 25 feet which is more conforming. The basement floor elevation will <br />remain at 66 feet. They cannot fill in the basement due to the landbank and the <br />topography. The National Heritage is satisfied as well as an arborist being hired. The <br />• house needs to placed where it is proposed due to Conservation requiring the Beech trees <br />are being required to remain where they are and the septic system is staying where it is as <br />due to the expense. The Board reviews the plans and Jonathan Furbush makes a motion <br />to grant the Special Permit. Robert Nelson seconds the motion. All agree. So moved. <br />Jonathan Furbush makes a motion to grant a 25 foot variance to the wetlands. Robert <br />Nelson seconds the motion. All agree. So moved. Reference plans from Cape & Islands <br />Engineering, dated May 8, 2008 revised July 17, 2008, revised July 29, 2008. <br />Robert Dobson: Requests a Variance from Section 174-31 of the Zoning By- <br />laws to seek relief from the setback requirements in order to build a 12'x 18' <br />shed on property located in an R-3 zoning district at 11 Squaws Lane (Map 117 <br />Parcel 78) Mashpee, Ma. <br />Sitting: Robert Nelson, Jonathan Furbush, Zella Elizenberry, James Reiffarth and <br />William Blaisdell. <br />Brian Warburton from Salt Spray Sheds represents the applicant at this hearing. They are <br />seeking a variance from the setback requirements in order to build a 12' x 18' shed. <br />Robert Nelson asks Mr. Warburton and/or Rich Stevens the difference between a shed <br />and a garage? Mr. Stevens says that whatever the applicant is applying for ... that is <br />what it should be referred to as. Mr. Warburton states that the plot plan currently shows <br />the shed 10 feet off the lot line. Actually, the applicant would like it pushed 5 feet closer <br />• to the lot line thus requesting a 10 foot variance on the side and a 5 foot variance in the <br />rear.
