A0VN <br />Town of Mashpee <br />.' 16 Grew ,Neck q�oad ,Vor•th <br />a� <br />r <br />Nla,shpcc, Massachusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />Decision for a Variance <br />RE: Stephen Lempitski 102 Captains Row <br />Map 96 Block 14 <br />A Petition was filed on September 16, 2008 for a Variance from Section 174- <br />2519 of the Zoning By-laws for permission to exceed the 70-foot total length limit to <br />allow for construction of a pier, ramp and float on property located in an R-3 zoning <br />district at 102 Captains Row (Map 96 Block 14) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on September 26, 2008 and <br />October 3, 2008, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, October 8, 2008, at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: Robert Nelson, James Reiffarth, William <br />Blaisdell, Peter Hinden and Jack Dorsey. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />John Slavinsky of Cape & Islands Engineering represents the applicant. They are <br />seeking a variance for a dock that is in excess of 70 feet. The Harbor Master requested <br />that the distance be extended and therefore it made the dock 92 feet in length. Richard <br />York, Shellfish Warden approved the dock by memo submitted to the ZBA. They are <br />currently delayed in Conservation due to a DEP file number which should be cleared up <br />at the next hearing. The Board reviews the plans with Mr. Slavinsky. James Reiffarth <br />makes a motion to grant the 22 foot variance for the dock. <br />
