A0VN Town of Mashpee .' 16 Grew ,Neck q�oad ,Vor•th a� r Nla,shpcc, Massachusetts 02649 MASHPEE ZONING BOARD OF APPEALS Decision for a Variance RE: Stephen Lempitski 102 Captains Row Map 96 Block 14 A Petition was filed on September 16, 2008 for a Variance from Section 174- 2519 of the Zoning By-laws for permission to exceed the 70-foot total length limit to allow for construction of a pier, ramp and float on property located in an R-3 zoning district at 102 Captains Row (Map 96 Block 14) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 26, 2008 and October 3, 2008, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, October 8, 2008, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, James Reiffarth, William Blaisdell, Peter Hinden and Jack Dorsey. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of Mashpee Zoning By-laws. John Slavinsky of Cape & Islands Engineering represents the applicant. They are seeking a variance for a dock that is in excess of 70 feet. The Harbor Master requested that the distance be extended and therefore it made the dock 92 feet in length. Richard York, Shellfish Warden approved the dock by memo submitted to the ZBA. They are currently delayed in Conservation due to a DEP file number which should be cleared up at the next hearing. The Board reviews the plans with Mr. Slavinsky. James Reiffarth makes a motion to grant the 22 foot variance for the dock.
