Mashpee Zoning <br />Board of Appeals Minutes <br />0 1 October 22, 2008 <br />Zoning Board of Appeals <br />Minutes — Wednesday, October 22, 2008 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on <br />Wednesday, October 22, 2008 at the Mashpee Town Hall. Board <br />Members Robert Nelson, James Reiffarth, William Blaisdell, Jonathan <br />Furbush were present along with Alternate member Peter Hinden. <br />Member Jack Dorsey was absent due to illness. <br />Chairman Robert Nelson opens the hearing at 7:00 p.m. <br />Richard and Catherine Harris: Requests a Variance from Section 174-31 <br />seeking relief from the front yard setback requirements in order to build a 12'x <br />24' addition on property located in an R-5 zoning district at 71 Ashumet Avenue <br />• (Map 41 Parcel 24) Mashpee, MA. <br />Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, Peter Hinden and <br />William Blaisdell. <br />Richard Harris represents himself at this hearing. They are seeking a variance <br />on the front setback in order to build a 12'x 24' living room. The Board reviews <br />the plans with applicant and Mr. Nelson explains that he will need a 6' foot <br />opening or the addition will be considered a bedroom. The Board of Health has <br />indicated that he is allowed a 5 bedroom dwelling. Mr. Harris informs the board <br />that his intention is for this to be a living room. The Board will need new plans <br />drawn up to show the proposed deck rather than just what is existing on the <br />plans. Mr. Harris agrees to have new plans dropped off as soon as possible. <br />James Reiffarth makes a motion to grant a 6.9 foot variance to Ashument <br />Avenue since the set back requirement is, 40 feet: Jonathan Furbush seconds the <br />motion. All agree: So moved. The variance is granted contingent on plans from <br />Yankee Land Surveyors from Marstons Mills, MA, dated April 8, 2008 and revised <br />October 27, 2008. <br />Carol D. Kellev: Requests a Variance from Section 174-33 seeking relief from <br />the required distance to the wetlands in order to build a deck on property located <br />is in an R-3 zoning district at 174 Captains Row (Map 96 Parcel 30) Mashpee, MA. <br />
