Board
Members Robert Nelson, James Reiffarth, William Blaisdell, Jonathan
Furbush were present along with Alternate member Peter Hinden.
Member Jack Dorsey was absent due to illness.
Chairman Robert Nelson opens the hearing at 7:00 p.m.
Continued Matter
Frank Silva: (for Auto Body Shop) Requests a Special Permit from Section
174-25F(3) of the Zoning By-laws in order to operate an auto repair shop on
property located in a C-1 Zoning District at 129 Industrial Drive (Map 88 Parcel
98) Mashpee, MA.
• Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, Peter Hinden and
William Blaisdell.
Diane Thompson, a zoning consultant represents Gary Beaulieu for Foley
Autobody shop. He came before the ZBA initially to get a Special Permit in order
to open and operate an auto repair shop. Applicant came to the Board in August
requested a Special Permit to operate an auto body repair shop. Upon some
investigating, it was determined that there were a number of things required in
the original Special Permit that was issued to Mr. Silva in 2004 that were not
completed. Some of the changes were attributed to Mr. Beaulieu's request to
run an auto body shop, however there are several other issues that were the
responsibility of the owner of the property, Mr. Silva. Ms. Thompson informs the
Board -that the items below have been addressed as follows:
1) Adequacy of parking: the site plan review determined that 26 parking
spaces are adequate for the existing uses and the proposed use for
automotive repair. Two handicapped spots (one van accessible) are
provided in accordance with ADA requirements.
2) Sprinkler System: a letter from James McHuth, JB Engineering was
• submitted to the Fire Department and the ZBA which states that the
sprinkler system was installed in the building for the contractor use is
also adequate for the automotive repair shop.
