Mashpee Zoning <br />Board of Appeals Minutes <br />3 November 12, 2008 <br />Frank Silva: Requests a Modification of a Special Permit from Sections 174- <br />25(G)4, 7 and 9 of the Zoning By-laws (to amend SP -04-29) to extend the time <br />to complete the requests of the ZBA that include the parking lot top -coat paving, <br />striping the parking lot spaces and make one van accessible and moving the <br />location of the dumpster, fencing it in and putting it on a concrete foundation not <br />to exceed 12 months beginning from the date the Modification of the Special <br />Permit is filed with the Town Clerk on property located in an I-1 zoning district at <br />129 Industrial Drive (Map 88 Parcel 98) Mashpee, MA. <br />Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, Peter Hinden and <br />William Blaisdell. <br />8) Diane Thompson, a zoning consultant represents Gary Beaulieu for <br />Foley Autobody shop. He came before the ZBA initially to get a <br />Special Permit in order to open and operate an auto repair shop. <br />Applicant came to the Board in August requested a Special Permit <br />to operate an auto body repair shop. Upon some investigating, it <br />was determined that there were a number of things required in the <br />original Special Permit that was issued to Mr. Silva in 2004 that <br />were not completed. Some of the changes were attributed to Mr. <br />Beaulieu's request to run an auto body shop, however there are <br />several other issues that were the responsibility of the owner of the <br />property, Mr. Silva. He has filed a Modification of the Original <br />Special Permit (SP -08-48). Along with this Special Permit filed by <br />Mr. Beaulieu (SP -0837) Mr. Silva has agreed to complete all <br />requirements set forth by the ZBA by December 31, 2009Sprinkler <br />System: a letter from James McHuth, JB Engineering was <br />submitted to the Fire Department and the ZBA which states that <br />the sprinkler system was installed in the building for the contractor <br />use is also adequate for the automotive repair shop. <br />The ZBA has informed both Mr. Silva and Mr. Beaulieu that the above mentioned items <br />are to be completed no later than December 31, 2009 or the Special Permit for the entire <br />building will be recinded. They have been more than patient since 2004 for these items <br />to be completed — there will be no exceptions. The Board will move to grant the Special <br />Permit for the repair shop and for the modification of the special permit to Mr. Silva with <br />
