• <br />• <br />Mashpee Zoning <br />Board of Appeals Minutes <br />3 January 10, 2007 <br />Louise Berman: Ms. Berman is a resident on Algonquin Avenue and directly across <br />from the emergency exit proposed on this street. She is very concerned about more <br />paving being done on that exit. Mr. Bonvie informs her that there must be something <br />solid for any emergency vehicle to gain access as well as it being plowed in the winter <br />time. He insists no construction equipment will use this entrance on Algonquin Avenue. <br />She is also concerned with the buffer strip not being properly vegetated over the years. <br />Mr. Bonvie informs her and the Board that they have done 2 sets of plantings due to <br />harsh weather and will continue to provide upkeep to that area. Ms. Berman also <br />mentions the topography has several steep drops and sand pits. She also mentions that <br />the start of up of construction time should be looked into as many times trucks idled far <br />earlier than 7:00 a.m. Mr. Nelson informs her that this is a planning Board issue. <br />Motion: Robert Nelson makes a motion to recommend conceptual approval for <br />Phase III as submitted with a letter being submitted to the Planning Board on <br />pushing back several units along with several other recommendations. Frederick <br />Borgeson seconds the motion. All agree. So moved. <br />Mr. Nelson suggests that the Planning Board consider using envelopes on all the building <br />lots. Additionally, the Board would like to see units 52, 53, and 54 pulled back 10 feet <br />from the buffer zone. Mr. Bonvies suggest they may make the decks 12 feet instead of <br />14 feet and adjust the roadway system to get more of the setback in tact. The Board also <br />suggest uni 56 G be moved back from the lot line and be made into a tri-plex rather than <br />a quad -flex. <br />Mr. Lloyd Allen and Charlotte Bocuzzi address the Board regarding the walkway on <br />Payamps Road. They are asking to build a four foot walking path. Mr. Nelson tells them <br />that although it is a nice idea, the ZBA has no jurisdiction regarding any property outside <br />the Southport lines for this hearing/meeting. They recommend and direct them to go to <br />the Board of Selectmen for further guidance. <br />Kathleen Girelli: Requests a Special Permit from Section 174-45.4 of the Zoning By- <br />laws to legalize an existing accessory dwelling on property located in an R-5 zoning <br />district at 32 Highview Avenue (Map 49 Parcel 124) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Frederick Borgeson, and <br />Jonathan Furbush, <br />Kathleen Girelli represents herself at this hearing. She is seeking to legalize an existing <br />accessoary apartment that is currently in her basement. The Board reviews the floor <br />plans and pictures she has submitted. She has completed the Plan Review Process as <br />well. The Board of Health has allowed up to 4 bedrooms in the dwelling. There still <br />needs to be an inspection by the Building Inspector. Marshall Brem makes a motion to <br />grant the special permit. Jonathan Furbush seconds the motion. All agree. A roll call <br />vote is taken. Marshall Brun votes yes. Jonathan Forbush votes yes. Robert Nelson <br />votes yes. Zella Elizenberry votes yes. Frederick Borgeson votes yes. So moved. <br />
