Mashpee Zoning <br />Board of Appeals Minutes <br />5 January 10, 2007 <br />• John Slavinsky of Cape & islands Engineering represents the applicant at this hearing. <br />They are seeking a special permit to relocate the existing dock facility (landing and ramp) <br />and reconstruct the existing float with maintenance in perpetuity. They plan to move it <br />and put pilings in. The new float will be 6' x 25' and the ramp will be extended beyond <br />the wooden walkway to secure a 5 foot passage under the walkway. The Board reviews <br />the plans and finds the application to be reasonable. The Conservation Commission has <br />approved the plans as well. There are no comments from abutters. Marshall Brem makes <br />a motion to grant the Special Permit. Frederick Borgeson seconds the motion. All agree. <br />So moved. Permit is conditioned on plans from Cape & Islands Engineering, dated <br />December 1, 2006, File No. I 1 I MA. <br />Eric and Dawn Peterson: Request a Variance from Section 174-31 of the Zoning By- <br />laws to seek relief from the setback requirements and lot size in order to build a garage <br />and expand existing living space on property located in an R-3 zoning district at 112 <br />Wading Place Road (Map*11 l Parcel 108) Mashpee, MA. <br />Eric and Dawn Peterson: Request a Special Permit from Section 174-17 of the Zoning <br />By-laws to alter a pre-existing non -conforming structure on property located in an R-3 <br />zoning district at 112 Wading Place Road (Map I 1 1 Parcel 108) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Jonathan Furbush and <br />Frederick Bergeson. <br />• lohn Slavinsky of Cape & Islands Engineering represents the applicants at this hearing. <br />They are seeking a special permit in order to alter a pre-existing non -conforming lot and <br />a variance for relief from setback requirements and existing landspace requirements in <br />order to build a garage. Initially the words "expand existing living space" should be <br />striken from the application. There is an existing dwelling already in the coastal bank <br />and they are seeking to build a 34' x 34' garage. They cannot meet the setback <br />requirements from Wading Place Road. Robert Nelson does not feel comfortable with <br />the way the application reads. The Board discusses options to remove the odd angles of <br />the garage. After some debate, Marshall Brem moves to grant the Special Permit. <br />Jonathan Forbush seconds the motion. A roll call vote is taken. Marshall Brem votes <br />yes. Jonathan Furbush votes yes. Zella Elizenberry votes yes. Robert Nelson votes no. <br />Frederick Borgeson votes yes. The motion is carried 4-1. <br />Marshall Brem moves to grant an 11.3 foot frontyard setback variance to Wading Place <br />and a 14,000 square foot landspace variance.
