Mashpee Zoning <br />Board of Appeals Minutes <br />1 February 28, 2007 <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, February 28, 2007 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, February <br />28, 2007. at the Mashpee Town Hall. Board Members Robert Nelson, Zella Elizenberry, <br />Marshall Brem, Frederick Borgeson and Jonathan Furbush were present along with <br />alternate members James Reiffarth and George Bolton. Martin Gordon and Eric Dublirer <br />were absent. <br />Mr. Nelson brought the meeting to order at 7:00 p.m. <br />Continued HearinLys <br />,lames and Erika Stovich: Requests a Special Permit from Section 174-45.4 of the <br />Zoning By-laws in order to build an accessory dwelling on property located in an R-5 <br />zoning district at 19 Pierre Vernier Drive (Map 2 Parcel 151) Mashpee, MA <br />,Tames and Erika Stovich: Request a Variance from Section 174-31 of the Zoning By- <br />laws to seek setback relief in order to build an accessory structure on property located in <br />an R-5 zorvng district at 19 Pierre Vernier Drive (Map 2 Parcel 15 1) Mashpee, NIA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Frederick Borgeson and <br />Jonathan Furbush. <br />James and Erika Stovich represent themselves at this hearing. They are seeking a Special <br />Permit in order to build an'accessory apartment. The Board reviews the plans and Zella <br />Elizenberry informs them that the dwelling must be owner occupied and that the permit is <br />not given in perpetuity. This shall also be conditioned on approval from the Board of <br />Health. The applicant is also requesting a variance on the side yard. They need to <br />maintain 25 feet and are unable to. They are looking for 5.07 feet to the addition. There <br />are no comments from abutters. Marshall Brem moves to grant the Special Permit. <br />Frederick Borgeson seconds the motion. All agree. A roll call vote is taken. Marshal. <br />Brem votes yes. Frederick Borgeson votes yes. Jonathan Furbush votes yes. Zella <br />Elizenberry votes yes. Robert Nelson votes yes. So moved. . Marshall Brem moves to <br />grant a 5.07 foot variance to tine addition. Frederick Borgeson seconds the motion. All <br />agree. A roll call vote is taken. Marshal Brem votes yes. Frederick Borgeson votes yes. . <br />Jonathan Furbush votes yes. Zella Elizenberry votes yes. Robert Nelson votes yes. So <br />moved.
