Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on May 25, 2007 and Julie 1, <br /> 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 13, 2007 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James <br /> Reiffarth and George Bolton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Michael Borselli of Falmouth Engineering represents the applicant. Chairman <br /> Robert Nelson informs Mr. Borselli that he has the right to continue this hearing if he is <br /> not comfortable with only 4 people sitting instead of the full 5 person board. Mr. Borselli <br /> wishes to continue the hearing. He is seeking a special permit in order to build a pier, <br /> ramp and float on what is presently a vacant lot. The Board reviews the plans while Mr. <br /> Borselli informs them of the specifies of the request. There are no navigational issues <br /> and adequate water depth. Richard York, Shellfish Constable, comments in a memo <br /> dated April 18, 2007 that the proposed float would restrict shellfishing productivity <br /> because it is too wide. He suggests to eliminate the 4' x 8' float and reduce the other <br />
