Mashpee Zoning Nancy Cook 2
Board of Appeals SP-07-34
float to 6' feet wide from 8' wide. Harbormaster Perry Ellis has requested the 2'
reduction in width be made from the outside of the float so that the outside edge is 2 feet
closer to shore. The applicant has accommodated all requested changes. The Board
discusses their concern that they do not grant Special Permit for docks to a vacant piece
of land unless substantial commencement of construction has begun on the dwelling.
Several abutters have comments.
Robert Webster of 407 Monomoscoy Road has no general objection to the project.
However, his concern is that a dock is built and it turns into a parking area with no home
on the premises for security purposes.
Beverly Ryan of 399 Monomoscoy Road wishes to convey the same concerns. She has
no objection to the dock either but wants a home built to accompany the project.
Robert Francoeur of 411 Monomoscoy Road speaks about the same concerns. Again,
he has no objection to the project but also wants a dwelling on the property.
The Board wishes to condition the Special Permit request on the applicant obtaining an
occupancy permit before construction of the pier, ramp and float can begin. All members
feel this is the best way to proceed with this matter. The abutters are satisfied with this
condition as well. Mr. Borselli agrees to comply with this condition. The Board makes a
motion to grant the Special Permit.
SPECIAL PERMIT CRITERIA
Section 174-25.I.9 states that the Board must find that the structure will not
unduly interfere with the free passage of travel by water or land or cause or contribute
to the substantial disruption or degradation of the marine or coastal environment.
GENERAL FINDINGS
1. that the subject property is located at 401 Monomoscoy Road and contains
25,755 square feet.
SPECIFIC FINDINGS
The Board determined that:
1. the proposed dock will be an accessory to a dwelling that will have an
occupancy permit before building begins and is a permissible use upon the
grant of a Special Permit.
