Mashpee Zoning
Board of Appeals Minutes
I June 13, 2007
TOWN OF MASHPEE
Zoning Board of Appeals
Minutes — Wednesday, June 13, 2007
The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, June 13,
2007 at the Mashpee Town Hall. Board Members Robert Nelson and Jonathan Furbush
were present. Also present were alternate members George Bolton and James Reiffarth.
Board members Marshall Brem, Frederick Borgeson and Zella Elizenberry were absent.
Alternate members Eric Dublirer and Martin Gordon were absent.
Mr. Nelson brought the meeting to order at 7:00 p.m.
Nanev Cook: Requests a Special Permit from Section 174-25 1 (9) of the Zoning By-
laws in order to build a pier, ramp and float on property located in an R-3 zoning district
at 401 Monomoscoy Road (Map 124 Parcel 64) Mashpee, MA.
Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth and George Bolton.
• Michael Borselli of Falmouth Engineering represents the applicant. Chairman Robert
Nelson informs Mr. Borselli that he has the right to continue this hearing if he is not
comfortable with only 4 people sitting instead of the full 5 person board. Mr. Borselli
wishes to continue the hearing. He is seeking a special permit in order to build a pier,
ramp and float on what is presently a vacant lot. The Board reviews the plans while Mr.
Borselli informs them of the specifics of the request. There are no navigational issues
and adequate water depth. Richard York, Shellfish Constable, comments in a memo
dated April 18, 2007 that the proposed float would restrict shellfishing productivity
because it is too wide. He suggests to eliminate the 4' x 8' float and reduce the other
float to 6' feet wide from 8' wide. Harbormaster Perry Ellis has requested the 2'
reduction in width be made from the outside of the float so that the outside edge is 2 feet
closer to shore. Tile applicant has accommodated all requested changes. The Board
discusses their concern that they do not grant Special Permit for docks to a vacant piece
of land unless substantial commencement of construction has begun on the dwelling.
Several abutters have comments.
0
