Crocker, Jr. 160 Falmouth Road Road <br /> Map 54 Parcel 248 <br /> SP-07-50 <br /> A Petition was filed on July 3, 2007 by James H. Crocker, Jr. of Osterville, <br /> Massachusetts for a Special Permit under Sections 174-24.(A)(4); 174-24(C); 174-25 <br /> (D)(1) and(D)(2) of the Zoning By-laws to add the medical use to allow for construction <br /> of a commercial building with retail sales on property located in a C-2 and R-5 zoning <br /> district at 160 Falmouth Road (Map 54 Parcel 248) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on July 27, 2007 and August <br /> 3, 2007 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 8, 2007, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James <br /> Reiffarth, George Bolton and Martin Gordon. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane of Dunning and Kir ane represents the applicant at this <br /> hearing to modify the existing Special Permit and add a medical use of the zoning by <br /> laws to the permit. Applicant requested and was granted a Special Permit to construct a <br /> commercial building with 28 parking spots to be made available. They will be adding <br /> one additional handicapped parking spot for each building, totaling six spots. <br /> Jonathan Furbush moves to grant the modification of the Special Permit for 160 <br /> Falmouth Road (SP-02-87) to add medical use. The motion is seconded. The Special <br /> Permit is granted. <br />
