Mashpee Zoning <br /> Board of Appeals James H. Crocker, Jr. <br /> 2 SP-07-50 <br /> : (160 Falmouth Road) <br /> GENERAL FINDINGS <br /> 1.The property is located at 160 Falmouth Road and contains 60,899 square feet. <br /> SPECIAL PERMIT CRITERIA <br /> A special permit may be approved only if it is determined that the proposed use or <br /> development is consistent with applicable state and town regulations, statutes, <br /> bylaws and plans, will not adversely affect public health or safety, will not cause <br /> excessive demand on community facilities, will provide adequate off-street <br /> parking, will not cause excessive erosion or cause increased runoff onto <br /> neighboring properties or into any natural river, stream, pond or water body and <br /> will not otherwise be detrimental to the town or the area. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposed use and development are consistent with applicable law, rules and <br /> regulations. <br /> 2. there will be no adverse effect on public health or safety. <br /> 3. there will not be an excessive demand upon community facilities created as a result of <br /> the proposal. <br /> 4. there will not be a significant adverse impact on the enviromriental factors listed in <br /> Section 174-24.C.2. <br /> 5. the proposed use, which while not specifically allowed by right or by Special Permit <br /> in the district, is similar to other uses allowed by right or by Special Permit and <br /> substantially dissimilar to prohibited uses. <br /> In view of the foregoing,the Maslipee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on August 8, <br /> 2007. There were no new plans submitted with this application. <br />
