Mashpee Zoning <br />Board of Appeals Minutes <br />2 August 8, 2007 <br />• Shawn Gilfov: Requests a Variance from Section 174-31 of the Zoning By-laws in order <br />to seek setback relief to build an 8' x 12' bathroom/laundry room on property located in <br />an R-3 zoning district at 72 Clover Lane (Map 117 Parcel 123) Mashpee, MA. Owner of <br />Record: Eleanor Demartino <br />Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, Zella Elizenberry and George <br />Bolton. <br />Shawn Gilfoy, the builder for the applicant represents Ms. DeMartino from this continued <br />hearing on July 25, 2007. Mr. Gilfoy was asked to amend his plot plan by showing <br />where the septic system is and what the lot coverage will be when the expansion/addition <br />is complete. The lot coverage proposed will be at 14.5% well under the 20% maximum <br />coverage allowed. The Board asks why the addition cannot be done out towards the back <br />of the house. Mr. Gilfoy tells them it is very costly move the hulkhead and there is an <br />existing outside shower in the back that was just built. There is also a septic systems that <br />would be too close to the addition. After some discussion, Jonathan Furbush moves to <br />grant a 7.6 foot variance. James Reiffarth seconds the motion. All agree. So moved. <br />Condition variance on plans from MacDougall Surveying & Associates, dated Joie 8, <br />2007 and revised July 26, 2007 and architectural plans dated June 6, 2007. <br />Peter Merlino: Requests a Variance from Section 174-25 (I)(9) of the Zoning By-laws <br />to have their existing dock extend beyond the maximum length of 70 feet from the mean <br />• high water on property located in an R-3 zoning district at 18 Quaker Run Road (Map 83 <br />Parcel 212) Mashpee, MA. Owner of Record: Shoestring Bav Trust <br />Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, Zella Elizenberry and George <br />Bolton. <br />Peter Merlino represents himself at this hearing. They are seeking a variance in order to <br />extend their existing pier beyond the 70 feet that is allowed under the current zoning. <br />They are seeking a 29 foot variance. They have been approved by Conservation the <br />Board notes that the water is very shallow over there. There are no comments from Shell <br />fish or Harbormaster. Zella Elizenberry moves to grant a 29 foot variance to the existing <br />pier. Robert Nelson seconds the motion. All agree. So moved. Reference plans from <br />Matson Engineering & Design Services, dated March 18, 2007 revised July 7, 2007. <br />Mashnee 130 Shops, Inc.: Requests a Special Permit for Findings of Fact under the <br />new amended Zoning By-laws Section 174-17 to determine that the proposed project is <br />not more detrimental than the existing structure whereby applicant proposes to raze the <br />presently unoccupied buildings on property located in a C -3/C-2 zoning district at 470 <br />Main Street (Map 27 Parcel 21) Mashpee, MA. <br />Sitting: Robert Nelson, Jonathan Forbush, James Reiffarth, Zella Elizenberry and George <br />Bolton. <br />0 <br />
