Mashpee Zoning <br />Board of Appeals Minutes <br />• 2 September 12, 2007 <br />Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, George Bolton and James <br />Reiffarth. <br />• <br />• <br />John Slavinsky represents the applicant at this hearing. They are seeking a variance in <br />the front and on. the sideyard. Mr. Slavinsky explains that although the lot is almost an <br />acre there is a vernal pool in the rear of the lot and that of course necessitates <br />conservation to have the house be at least 100 feet from the vernal pool. Applicant hired <br />a consultant who specializes in this matter and an order of conditions was issued on <br />December 2, 2004 which is good until December 2, 2007. The neighborhood consists of <br />houses that all have 2 car garages however due to the limits of this lot, Mr. Marsters is <br />proposing to make the garage a one car and the house smaller. They have placed the <br />house in the best position they can but 'still need a setback -variance. The remainder of the <br />lot will forever be conservation restricted. Applicant is also burdened with a double <br />frontage and must adhere to 40 feet setbacks on both fronts. Mr. Nelson informs the <br />applicant that the road was just paved and taken as a public way. He does not want to see <br />the road destroyed with heavy construction trucks. Mr. Marsters states that he will put a <br />stone apron on the pavement to protect it. The whereabouts of the gas line is also <br />questioned and Mr. Marsters states this is not a problem. <br />Louis Falcone of 62 Wintergreen has some questions for the applicant. He has no <br />problem with the project but was just curious to see if it fits the neighborhood. He <br />reviews the plans and has no problems with the project. <br />Mr. Nelson feels there is plenty of burden to grant the variance for applicant. Jonathan <br />Furbush moves to grant a 2 foot frontyard setback variance and a 4 foot variance on the <br />northerly side. Zella Elizenberry seconds the motion. All agree. So moved. Reference <br />plans from Ferreira Associates of Falmouth, MA, dated May 25, 2004, Plan No. WO I. <br />Mr. Nelson asks the Board to sign the mylar plans from the McShane 40B. Seeing no <br />further business, Jonathan Furbush makes a motion to adjourn. Zella Elizenberry seconds <br />the motion. All agree.
