He is seeking a variance from the <br />sideyard setback requirements in order to remove and replace an old deck. The deck <br />exists as a non -conforming structure and was in place when applicant bought the property <br />a few months ago. He was unaware that he would need to obtain a variance in order to <br />make the deck safer and that it was non -conforming. He is asking for a 10 foot variance <br />on the southerly side. The Board reviews the plot plan. Since applicant inherited this <br />structure and wishes to bring it up to building code, the Board feels this is acceptable. <br />James Reiffarth makes a motion to grant a 10 foot variance on the southerly side. George <br />Bolton seconds the motion. All agree. So moved. Reference plans from Yankee Land <br />Surveyors of Marstons Mills, MA, dated September 7, 2007 and revised September 10, <br />2007. <br />Kimberlev Cramer: Requests a Special Permit from Sections 174-17 and 174-20 of the <br />Zoning By-laws in order to raze and replace existing dwelling on property located in an <br />R-3 zoning district at 250 Fells Pond Road (Map 116 Parcel 34) Mashpee, MA. <br />Kimberlev Cramer: Requests a Variance from Section 174-31 of the Zoning By-laws to <br />seek a landspace variance since the lot will not be large enough to meet current zoning <br />when the existing dwelling is torn down.on property located in an R-3 zoning district at <br />250 Fells Pond Road (Map 116 Parcel 34) Mashpee, MA. <br />• Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, George Bolton and James <br />R61`farth. <br />Doug Stefanov represents the applicant at this hearing. They are seeking a special permit <br />to demolish the existing dwelling and replace the house. Once the existing house is <br />razed, the lot will not be in line with the current zoning that requires vacant lots to be <br />40,000 square feet in that district. Applicant is requesting a variance for landspace relief, <br />and setback requirements in that the applicant is burdened with two frontages both <br />requiring a 40 foot setback. The proposed house is 30 feet from Fells Pond Road and is <br />basically no more detrimental than the existing dwelling that sits at 29.1 feet from Fells <br />Pond Road. The board reviews the plans and discusses a pool that is on the plans. Mr. <br />Stefanov informs the Board that it is only a proposal at the moment and if his client <br />decides to build it, the pool will not require any zoning relief. The lot coverage proposed <br />is 19.9 % and there are no comments from abutters. Snecial Permit: Jonathan Furbush <br />makes a motion to grant the Special Permit. Robert Nelson seconds the motion. All <br />agree. So moved. Variance: Jonathan Furbush makes a motion to grant the following: <br />✓ A 26,471 square foot landspace variance <br />✓ A 10 foot setback variance from Vale Lane <br />✓ A 10 foot setback variance from Fells Pond Road <br />• Robert Nelson seconds the motion.
