Town of Mashpee <br />Zoning Board of Appeals Minutes <br />1 October 24, 2007 <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, October 24, 2007 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, October <br />24, 2007. at the Mashpee Town Hall. Board Members Robert Nelson, Zella Elizenberry, <br />Jonathan Forbush, James Reiffarth and George Bolton were present along with alternate <br />member William Blaisdell. Alternate Member Martin Gordon was absent. <br />Robert Nelson opens the hearing at 7:00 p.m. <br />Zella Elizenberry reads the continuances. <br />The Hubert Trust, Janet & Barry Krock, Trustees: 'Request a Special Permit from <br />Sections 174-17; 174-20 and 174-24C of the Zoning By-laws to raze and replace a pre- <br />existing, non -conforming structure on property located in an R-3 zoning district at 4 <br />Cross Street (Map 128 Parcel 15) Mashpee, MA. <br />• The Hubert Trust. Janet & Barry Krock, Trustees: Request a Variance from Sections <br />174-28 and 174-31 of the Zoning By-laws to request 4% over maximum lot coverage in <br />order to raze and replace existing dwelling and rebuild new dwelling on property located <br />in an R-3 zoning district at 4 Cross Street (Map 128 Parcel 15) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, George Bolton, and James <br />Reiffarth. <br />Attorne Kevin Kirrane of Dunning & Kirrane represents the applicant at this hearing . <br />They are seeking a special permit to raze and replace the existing dwelling and a variance <br />to exceed the 20% lot coverage by 4%. The proposed house is 7 feet farther than the <br />existing house — less detrimental than the existing dwelling. The lot is 5,000 square feet. <br />There are several things that applicant proposes: <br />✓ Improving setbacks <br />✓ Replacing the cesspool <br />✓ Proposed dwelling is burdened with 2 frontages <br />✓ The abutter most impacted by this proposal is owned by applicant. <br />Applicant wants the same as what the other neighbors were afforded. Mr. Flanders is the <br />builder and has built several other homes in the neighborhood. The drainage is remaining <br />on site. Bob Nelson asks if the average setback rule can apply — Attorney Kirrane says <br />• that it can. The Board also asks if applicant intends to keep the property — yes applicant <br />
