0A <br /> id <br /> lbwn oj'Mashpee <br /> MASHPEE ZONING BOARD OF APPEALS 16 Great,_V�ek koacl,Morth <br /> Decision for a Variance Mashpec, iWassachusetts 02649 <br /> RE: Vernon Lawrence 160 Timberlane Drive <br /> Map 22 Parcel 8C <br /> V-07-67 <br /> A Petition was filed on October 15, 2007 for a Variance from the setback <br /> requirements from Section 174-31 of the Zoning By-laws in order to build a 24' x 28' <br /> detached garage on property located in an R-5 zoning district at 160 Timerlane Drive <br /> (Map 22 Parcel 8C) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on October 26, 2007 and <br /> November 2, 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,November 14, 2007 and continued until November 28, 2007, at which time <br /> the following members of the Zoning Board of Appeals were present and acting <br /> throughout: Robert Nelson, Zella Elizenberry, Jonathan Furbush, George Bolton and <br /> James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Lawrence's original variance petition was heard on November 14, 2007 at <br /> which time he presented plans to build a 24' x 28' detached garage. After in-Lich <br /> discussion between the Board and a direct abutter whom is against the variance request, <br /> the asked Mr. Lawrence to reduce the size of the garage and/or move it further back from <br /> the lot line so as to decrease the variance request. Abutter Janet Walsh of 166 <br /> Timberlane Drive had extreme opposition to this proposed garage and felt it was far too <br /> close to her property, would be detrimental to the ability to sell her property and felt the <br /> garage in general was too big for the lot and the neighborhood. Mr. Lawrence presents <br /> the new plans to the Board and has done what the Board requested. He pushed the garage <br />
