Mashpee Zoning <br />Board of Appeals <br />I <br />Minutes <br />November 28, 2007 <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, November 28, 2007 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, November <br />28, 2007. at the Mashpee Town Hall. Board Members Robert Nelson, Zella Elizenberry, <br />Jonathan Furbush, James Reiffarth and George Bolton. Alternate member William <br />Blaisdell was absent. <br />Robert Nelson opens the hearing at 7:00 p.m. <br />Zella Elizenberry reads the continuances. <br />EXECUTIVE SESSION - A roll call vote was taken to go into Executive Session — All <br />Members agree — The ZBA went into Executive Session at 7:00 and resumed the regular <br />Public Hearing at 7:10 p.m. <br />Vernon Lawrence: Requests a Variance from Section 174-31 of the Zoning By-laws to <br />seek relief from the setback requirements in order to build a detached 24' x 28' garage on <br />property located in an R-5 zoning district at 160 Timberlane Drive (Map 22 Parcel 8C) <br />• Mashpee, MA. <br />Sitting: In the absence of William Blaisdell, Robert Nelson will replace him since lie was <br />present at this hearing but not sitting. In addition to Mr. Nelson, sitting is Zella <br />Elizenberry, James Reiffarth, Jonathan Forbush and George Bolton. <br />Mr. Lawrence's variance petition was continued from November 14, 2007 at which time <br />he was asked to reduce the size of the garage and/or move it further back from the lot line <br />so as to decrease the variance request. Abutter Janet Walsh of 166 Timberlane Drive had <br />extreme opposition to this proposed garage and felt it was far too close to her property, <br />would be detrimental to the ability to sell her property and felt the garage in general was <br />too big for the lot and the neighborhood. Mr. Lawrence presents the new plans to the <br />Board and has done what the Board requested. He pushed the garage to 15.3 feet off the <br />lot line by moving it forward and closer to the house. The garage still remains at 28' x <br />24'. The Board reviews the plans and shows Ms. Walsh the new plans as well. She is <br />still not happy with the size of the garage and does not want the variance granted. The <br />Board thanks her for her input. Mr. Forbush asks Mr. Lawrence what type of landscaping <br />will be put between the neighbors house and his? He plans to put in arbovities which will <br />provide privacy. Mr. Nelson asks the Building Inspector if 4 feet between the building is <br />allowable — Mr. Stevens says that is fine. Mr. Nelson also indicates that the lot coverage <br />is 14% and is well under the 20% allowable maximum. The Board discusses that the lot <br />is difficult and the topography provides a problem for the applicant as far as where to <br />• place the garage as well. They discuss the height of the building to be 18'6, there will be <br />no second floor, no plumbing and no basement. Jonathan Forbush moves to grant 9.7 <br />foot variance on the northersly side, a 10.6 foot variance from Timberlane Drive and a <br />
