Reference plans <br />from Stephen Doyle and Associates of East Falmouth, MA, dated October 10, 2007, <br />revised November 26, 2007. <br />Holidav Pools/Heather Puopolo: Requests a Variance from Section 174-31 of the <br />Zoning By-laws to seek setback relief on a pool that was incorrectly installed and <br />previously granted a variance on property located in an R-3 zoning district at 53 Tobisset <br />Street (Map 38 Parcel 23) Mashpee, MA. Owner of Record: Heather Puopolo <br />Sitting: Robert Nelson, Zella Elizenberry, Jonathan Forbush, George Bolton and James <br />Reiffarth. <br />Walter Zerosky represents himself at this continued hearing. The Board has reviewed <br />this matter with Town Counsel and upon further discussion has decided to grant the <br />requested new variance of 23 feet to rectify measuring mistake. They inform Mr. <br />Zerosky that in the future he must use a registered land surveyor to measure out his pools. <br />He is very thankful to the Board and will definitely use a registered land surveyor in the <br />future. <br />Helen and Georgic MandiQo: Requests a Special Permit from Section 174-45.4 of the <br />• Zoning By-laws in order to build an accessory apartment on property located in an R-5 <br />zoning district at 166 Noisy Hole Road (Map 46 Parcel 71) Mashpee, MA.. <br />Sitting: Robert Nelson, Zella Elizenberry, George Bolton, James Reiffarth and Jonathan <br />I-urbush. <br />Helen and George Mandigo represent themselves at this hearing. They are seeking a <br />Special Permit for an accessory apartment for his mother. He has been through plan <br />review and the dwelling will blend in nicely with the home. Zella Elizenberry reminds <br />him that it must be owner occupied and that the permit is not given in perpetuity. The <br />parking provided on the plot plan is more than adequate. Jonathan Furbush makes a <br />motion to grant the Special Permit. Zella Elizenberry seconds the motion. All agree. So <br />moved. Reference plans from Stephen Doyle Associates of East Falmouth, MA, dated <br />October 18, 2007 and revised October 27, 2007. <br />Zella Elizenberry makes a motion to adjourn.
