30. Snow and ice removal shall be the responsibility of the Applicant or <br /> Homeowner's Association, unless and until the Town of Mashpee formally <br /> assumes such responsibility. The Final Site Plans shall indicate a suitably sized <br /> and located area for snow storage. Snow and ice removal shall be undertaken as <br /> soon as is practicable after snowfall and shall not impede or obstruct the roadway <br /> and driveways or the sight lines thereon and so as not to impede or obstruct the <br /> hydrants. Accumulated ice on the roadway, driveways and parking lots shall be <br /> promptly removed or sanded such that vehicles may pass safely. To the extent <br /> practical, use of sodium-based de-icers shall not be utilized. <br /> 31. The Board's engineer shall be charged with general oversight over the <br /> construction activities of the project. In this capacity, the Board's engineer shall <br /> provide monthly reports to the Board during times of active construction as set <br /> forth in Exhibit C attached hereto. Exhibit C, which is hereby incorporated into <br /> the conditions of this Comprehensive Permit, also sets forth minimum required <br /> protocol for inspection of project infrastructure. In addition to the minimal <br /> requirements set forth in Exhibit C, the Applicant shall also provide the Board's <br /> engineer with any pertinent photographs, logs, data or other information that may <br /> be helpful in the monitoring process. The Board's engineer's fee shall be paid by <br /> the Applicant in the mamler prescribed by G.L. c. 44, 553G. <br /> 32. Nothing herein may be construed as an acceptance or a guarantee of the Town's <br /> acceptance of the project's roadways as Town ways. Such acceptance can only be <br /> accomplished by normal statutory procedures. <br /> 33. The Applicant shall eliminate the proposed "civic building" on Lot 129. <br /> 34. No building permits for lots Ia, lb, 2-7, 14-23 or 25 may be issued until the <br /> Applicant provides easements from the owners (Mashpee Commons Limited <br /> Partnership) of the Mashpee Commons commercial development for access from <br /> the Mashpee Commons Parking Lot to said Lots 1 a, I b, 2-7, 14-23 and 25, as <br /> shown on the Plans. Such easements shall guarantee access in at least the inanner <br /> shown on the Plans and are subject to the prior approval of the Board's counsel, <br /> such approval not to be unreasonably witlilield. <br /> 35. Whiting Road between Lots 202 and 208, as shown on the Plans, shall not be <br /> constructed until such time as the Applicant provides the Board with evidence that <br /> it has adequate legal rights to construct such road. Until the legal rights to <br /> construct Whiting Road are established, access to Lots 203-208 shall be via Grove <br /> Street (with the access to Lot 202 being from Eastern Lane) and, the proposed <br /> house on Lot 209 may not be constructed. If the rights to construct Whiting Road <br /> are not established, and the Applicant still desires to construct the house on Lot <br /> 209, the Applicant must reconfigure such lot so as to provide adequate frontage. <br /> Such reconfiguration shall be shown on the Master Plans and Filial Site Plans. <br /> filial permit 19 <br />
