Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 13, 2006 and <br /> January 20, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was advertised on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 25, 2006 but continued until February 22, 2006 at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Robert Nelson, Zella Elizenberry, Frederick Borgeson, James Reiffarth and Marshall <br /> Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane represents the applicant at this hearing. They are seeking <br /> a special permit in order to build a commercial office building. There are currently <br /> similar office buildings in the surrounding area and this will not be detrimental to or <br /> cause any adverse impacts on the town or neighborhoods. The parcel is undeveloped and <br /> consists of 28,108 square feet. It has 125 feet of frontage and is the last lot to be <br /> developed on Cape Drive. The subject parcel is situated in a C-2 zoning district. This <br /> district requires newly created lots to have a minimum area of 40,000 square feet and 200 <br /> feet of frontage. A variance was granted in order to deem this lot buildable for the <br /> requested commercial office building, however, applicant was unaNvare of the twelve <br /> month expiration period and allowed it to lapse.
