°W ash <br /> Zonin <br /> and Ibbitson <br /> 16 G'reat Ycck 1�oa(l Xorth <br /> :dn,�c+� � Nlasht)cc, Nassachusctts O2649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Craig & Lorna Ibbitson 55 Pond Circle <br /> Map 64 Parcel 74A <br /> V-06-36 <br /> A Petition was filed on April 26, 2006 for a Variance from Section 174-31 of the <br /> Zoning By-laws to vary the current setback requirements in order to build a two car <br /> garage with a room above on property located in an R-3 zoning district at 55 Pond Circle <br /> (Map 64 Block 74A) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on April 28, 2006 and May 5, 2006, a copy of which is <br /> attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was scheduled on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 10, 2006 and postponed until May 24, 2006, at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Robert Nelson, Zella Elizenberry, Jonathan Forbush, James Reiffarth and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Craig and Lorna Ibbitson represented themselves at this hearing. They are <br /> seeking a variance in order to build a garage with a room above it. The have submitted <br /> letters in support of this project from abutting neighbors. Applicant has now submitted <br /> the original signed stamped plot plan for the Board to review. They are seeking side yard <br /> setback and front yard setback. There was a comment from the Board of Health that was <br /> since revoked and signed off on. They are allowed up to five bedrooms. The Board <br /> moves to grant the variances as requested conditioned on approval from Board of Health. <br /> } <br />
