Mashpee Zoning <br />Board of Appeals Minutes <br />1 June 14, 2006 <br />• TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes —Wednesday, June 14, 2006 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, June 14. <br />2006 at 7:00 p.m. at the Mashpee Town Hall. Board Members Robert Nelson, Zella <br />Elizenberry, Marshall Brem and Jonathan Furbush were present along with alternate <br />members James.Reiffatlh and Eric Dublirer. Board member Frederick Bergeson was <br />absent. <br />Mr. Nelson brought the meeting to order at 7:00 p.m. <br />Zella Elizenberry read the continuances for tonight's hearing. <br />J. Patrick Riley, Jr.: Requests a Special Permit from Section 174-45.4 of the Zoning <br />By-laws in order to legalize an existing accessory apartment in the basement on property <br />located in an R-3 zoning district at 30 Shorewood Drive (Map 58 Parcel 37) Mashpee, <br />MA. <br />• Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Jonathan Furbush and Eric <br />Dublirer. <br />Mr. Riley represents himself at this hearing. He is seeking a Special Permit in order to <br />legalize an existing accessory apartment that he has had for almost 20 years. Mr. Brem <br />asks the applicant why he has had this for so long and has not made it legal. Mr. Riley <br />says that he was unaware at the time that he needed a special permit. The Board <br />discusses whether or not he pulled a building application for this renovation. There is <br />some discussion as to what permits were pulled and whether all has been done by the <br />proper building code. Mr. Brem is very upset about why this continues to be allowed in <br />Mashpee with no fines imposed. There is much discussion with the Board regarding this <br />illegal apartment. Marshall Brem makes a motion to grant the special permit application. <br />Jonathan Forbush votes no.. Eric Dublirer also denies the motion. Zella Elizenberry <br />votes in favor. Robert Nelson votes in favor. Tile Motion is denied 3-2. A roll call vote <br />is taken. Mr. Brem votes yes, Mr. Forbush votes no, Mr. Dublirer votes no, Ms. <br />Elizenberry votes yes, Mr. Nelson votes yes. <br />Mark and Donna Jean Lopez: Requests a Variance from Section 174-31 of the Zoning <br />By-laws to seek relief from the landspace requirements on property located in an R-5 <br />zoning district at 103 Meetinghouse Road (Map 45 Parcel 50) Mashpee, MA. <br />• Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Jonathan Forbush and James <br />Reiffarth. <br />
