Mashpee Zoning <br />Board of Appeals Minutes <br />2 June 14, 2006 <br />• John Slavinsky of Cape & Islands Engineering represents the petitioners. <br />Originally, the applicants donated 17 acres of land to the Town of Mashpee. There was a <br />parcel left of 6.8 acres which he is looking to subdivide for his family at this point. There <br />is sufficient frontage and this R-5 zoning calls for 80,000 square feet for each parcel. Mr. <br />Lopez would like to create 2 additional lots for his children each containing 80,000 <br />square feet. This leaves the parcel that his home is presently situated on just shy of the <br />required 80,000 square feet. He is seeking a 2,800 square foot landspace variance to <br />deem this lot buildable in order to complete the subdividing. The Board discusses any <br />concerns the fire department may have as well as the road that will need to be built for <br />access the lots. The Board feels there is plenty of land available to have this parcel <br />subdivided and makes a motion to allow the Planning Board to take action on referring <br />the plan. The Board also moves to grant the 2,800 square foot landspace variance. <br />Marshall Brem moves to grant a 2,800 square foot landspace variance. Zella Elizenberry <br />seconds the motion. All agree. So moved. A roll call vote is taken. Mr. Brem votes yes, <br />Ms. Elizenberry votes yes, Mr. Nelson votes yes, Mr. Reiffarth votes yes and Mr. <br />Furbush votes yes. Motion is carried unanimously. A motion is also make to allow the <br />Planning Board to take action on referencing the plan. Reference plans from Cape & <br />Islands Engineering, dated April 22, 2006, File 188MA. <br />Peter Langler: Requests a Special Permit from Section 174-45.4 of the zoning by-laws <br />in order to build an accessory structure on property located in an R-3 zoning district at 5 <br />Surrey Place (Map 1 1 I Parcel 215) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Jonathan Furbush and Eric <br />Dublirer. <br />Daryl Chapman represents the petitioner at this hearing. They are seeking a special <br />permit in order to build an accessory apartment. They are able to meet the setback <br />requirements and are planning to eliminate one bedroom from the existing house in order <br />to accommodate the board of health's request to limit the entire number of bedrooms to a <br />• total of four.
