Mashpee Zoning <br />Board of Appeals Minutes <br />3 June 14, 2006 <br />• is a closet that could easily turn the open space into a bedroom. The want the closet <br />closed up in addition to the six foot opening. Mr. Chapman says if that is what they want <br />then he will discuss this with the home owners. Mr. Nelson feels that there should be no <br />construction work done to the inside without a permit. He feels the by-law is not being <br />interpreted correctly on this. Marshall Brem moves to grant the special permit. Zella <br />Elizenberry seconds the motion. Eric Dublirer votes in favor. Robert Nelson votes no. <br />Jonathan Furbush votes yes. Motion is carried 4-1. Reference plans from Christopher <br />Costa & Associates, Inc., dated March 2, 2006, revised April 14, 2006 and revised April <br />24, 2006 and design plans from Cotuit Bay Design of Mashpce, MA, dated May 13, <br />2006. <br />JellvBone LLC: Requests a Variance from Section 174-31 of the Zoning By-laws in <br />order to seek relief from the setback requirements and landspace requirements in order to <br />re -build a new dwelling on property located in an R-3 zoning district at 374 Monomoscoy <br />Road (Map 125 Parcel 17) Mashpee, MA. <br />• JellvBone LLC: Requests a Special Permit from Section 174-20 of the Zoning By-laws <br />in order to demolish the existing dwelling and rebuild a new dwelling on property located <br />in an R-3 zoning district at 374 Monomoscoy Road (Map 125 Parcel 17) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Eric Dublirer and Jonathan <br />Forbush. <br />John Proccasino represents himself at this hearing. He is seeking a special permit to <br />demolish and rebuild the existing dwelling. The narrow lot proposes a limited space use <br />and the detached garage up towards the front of Monomoscoy Road seems to be the best <br />spot for the garage with the new septic system. The Conservation Commission has <br />approved the plans. The new dwelling will not be more detrimental the area and a new <br />title v system will be a big improvement for the neighborhood. Marshall Brem moves to <br />grant the special permit. Jonathan Furbush seconds the motion. All agree. So moved. A <br />roll call vote is taken. Marshall Brem votes yes. Jonathan Furbush votes yes. Robert <br />Nelson votes yes. Zella Elizenberry votes yes. Eric Dublirer votes yes. Reference plans <br />from Steven Doyle and Associates, dated March 23, 2006, revised April 4, 2006 and <br />revised April 19, 2006. <br />There is also a variance request to the Board on this property in order to rebuild the new <br />dwelling. They need sideyard setback relief, landspace relief since the demolition of the <br />house will render the lot too small for the R-3 district and frontage relief. After <br />reviewing the plans and considering the narrow shape of the lot the board discusses the <br />. positive outcome of a new dwelling on that lot and the fact that there are several similar <br />situations that they have granted this type of relief for.
