1OWN <br /> Town oj'Mashpec <br /> 16 Greot,,Vck koad,X�)rth, <br /> Nkislipec, Wassacl iusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for Variance <br /> RE: Cape Cod Free Clinic and 32 Commercial Street <br /> Community Health Center Map 81 Parcel 129 and 18 <br /> V-06-53 <br /> A Petition was filed on July 11, 2006 for a Variance from Sections 174-31 and <br /> 174-38 of the Zoning By-laws to seek relief from the setback requirements and to reduce <br /> the parking stall dimensions on property located in an 1-1 zoning district at 32 <br /> Commercial Street (Route 28) (Map 81 Parcel 129 and 18) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on July 28, 2006 and August <br /> 4, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 9, 2006, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Eric <br /> Dublirer, Jonathan Furbush and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Paula Schnepp, Director of the Cape Cod Free Clinic represents the applicants at this <br /> hearing along with Tim Santos of Holmes & McGrath. The Clinic is seeking to build a <br /> new building on land that was given to them by the town of Mashpee. There was a total <br /> of 4.6 acres originally granted. The clinic is looking to lease 2.6 acres of the land and <br /> give the remainder back to the town. Selectman John Cahalane spoke on behalf of the <br /> Board of Selectman supporting this endeavor for the benefit of the town. He also <br /> informed the ZBA that the Board of Selectman had voted to release as much of the land <br /> as the Clinic would need to use, Mr. Nelson asks if there is a recordable plan.
