Mashpee Zoning <br /> Board of Appeals Cape Cod Free Clinic and <br /> 2 Community Health Center <br /> V-06-53 <br /> as the Clinic would need to use. Mr. Nelson asks if there is a recordable plan. There is <br /> not yet as they are still questioning the set up. They would like to have a 99 year lease <br /> and should obtain a recordable lease as soon as possible. The special permit they are <br /> requesting is for the use of medical offices/clinic in an industrial zone. They are also <br /> seeking a variance due to the unique shape of the lot and that the topography is <br /> problematic. They are requesting 41 feet to the street line and 17 feet to the property line <br /> for relief. They are also requesting to reduce the size of the parking spaces to 9' x 19' <br /> with 24 feet in between. There shall be 3 handicapped spaces against the building. There <br /> are 50 spaces proposed and about 15-20 will be for staff. Carlos Ferre, the Architect, <br /> addresses the Board about the entrances. He tells them there will be one main entrance <br /> with 2 other exits. The heating will be done by gas. The Design Review Committee and <br /> the Plan Review Committee have endorsed this project. There shall be no access from <br /> Route 28. The Board reviews and discusses the plans and finds that the Clinic will be a <br /> huge benefit to the Town of Mashpee. The Board makes a motion to grant the following <br /> variances: <br /> ✓ To allow the parking spaces to be reduced to 9' x 19' <br /> ✓ A 34 foot variance from the front setback <br /> ✓ A 13 foot variance for the sideyard setback. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 32 Commercial Street and contain 4.6 <br /> acres. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> the subject lot and not the district in which it is located. <br />
