Mashpee Zoning <br /> Board of Appeals David Hufiiagel <br /> 3 SP-06-66 <br /> Owner of Record: James Kalweit <br /> 5. will not have a significant adverse impact on wildlife habitat, estuarine <br /> systems, traffic flow, traffic safety, waterways, fisheries, public lands or <br /> neighboring properties. <br /> 6. will not cause excessive levels of noise, vibrations, electrical disturbance, <br /> radioactivity or glare. <br /> 7. will not destroy or disrupt any species listed as rare, endangered or threatened <br /> by the Massachusetts Natural Heritage Program or any known historic or <br /> archaeologic site. <br /> 8. will properly dispose of stumps, construction debris, hazardous materials and <br /> other waste. <br /> 9. will provide adequate off-street parking. <br /> 10. will not cause excessive erosion or cause increased runoff onto neighboring <br /> properties or into any natural river, stream, pond or water body and will not <br /> otherwise be detrimental to the town or the area. <br /> 11. while the proposed structure will increase the non-conforming nature of the <br /> structure, the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> 12. All requirements from the Department of Public Works and the Fire <br /> Department will be satisfied. <br /> 13. A letter will be delivered first class mail to the abutters informing them of the <br /> roadwork that will be done. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on January <br /> 10, 2007 to grant a Special Permit. The Special Permit is conditioned upon compliance <br /> with the site plans plans from J. E. Landers-Cauley of West Falmouth, MA, dated <br /> August 10, 2006, revised, September 20, 2006, revised September 26, 2006, and revised <br /> again October 16, 2006.
