Mashpee Zoning <br />Board of Appeals Minutes <br />• 4 October 25, 2006 <br />Section <br />Patricia Charman: Requests a Variance from Section 174-31 of the Zoning By-laws to <br />seek relief from the setback requirements in order to expand existing dwelling by <br />building a screened porch on property located in an R-5 zoning district at 16 Autumn <br />Drive (Map 22 Parcel I OD) Mashpee; NIA. <br />Sitting: Robert Nelson, Zella Elizenberry, Frederick Borgeson, Marshall Brem; and <br />Jonathan Forbush. <br />David Rota of Scroll Construction represents the applicant at this hearing. They are <br />seeking variance relief in order to build a 10 x 25 screen porch on the front of their house. <br />The Board reviews the plans and Mr. Brem said he visited the site and feels this would be <br />an improvement to the residence. They are looking for a 9.61 foot variance in order to <br />meet the 40 foot setback requirement from the front of the property. Marshall Brem <br />makes a motion to grant the 9.61 foot variance. Frederick Borgeson seconds the motion. <br />All agree. A roll call vote is taken. Marshall Brem votes yes, Frederick Borgeson votes <br />yes. Zella Elizenberry votes yes. Robert Nelson votes yes. Jonathan Forbush votes yes. <br />Reference plans from Robert Hannigan Associates of Quincy, MA, dated August 25, <br />2006 and revised September 21, 2006. <br />Whorton-Obrinskv Trust: Requests a Variance from Section 174-31 of the Zoning By- <br />laws in order to deem lot buildable on property located in an R-5 zoning district at 231 <br />• Wheeler Road (Map 49 Parcel 33) Mashpee, MA. <br />Whorton-Obrinskv Trust: Requests a Variance from Section 174-31 of the Zoning By- <br />laws in order to deem lot buildable on property located in an R-5 -zoning district at 227 <br />Wheeler Road (Map 49 Parcel 34) Mashpee, MA. <br />Whorton-Obrinskv Trust: Requests a Variance from Section 174-31 of the Zoning By- <br />laws in order to deem lot buildable on property located in an R-5 zoning district at 223 <br />Wheeler Road (Map 49 Parcel 35) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Frederick Borgeson, Marshall Brem, and <br />Jonathan Forbush. <br />Attorney Brian Garner of Dunning R Kirrane represents the applicants at this hearing. <br />They are seeking variance relief to be able to construct single family residential structures <br />on three separate lots as referenced above. The lots to were given to the brothers and <br />sisters by their parents. Applicants have learned that the Town had merged the lots due <br />to their common ownership by their parents. They have applied for variance relief to re- <br />establish these lots as separate and buildable lots. The lots are identified separately and <br />taxed individually, each assessed at about $112,000. Each lot contains approximately <br />11,250 square feet with 75 feet of frontage which is consistent with the lots in the <br />surrounding area. The zoning in this area is an R-5 which requires 80,000 square feet. <br />The intent of the original owners was clearly to keep these -individual building lots. The <br />• lots are located in an area which has been heavily developed and their proposal will result <br />in the construction of typical single family homes much like what is already in existence <br />
