Mashpee Zoning <br />Board of Appeals Minutes <br />5 October 25. 2006 <br />• in the neighborhood. The Board discusses the size of the lots and the possibility of <br />joining all three lots together. It is suggested that a very large home could then be built <br />on that one lot and it would deregate from the look of the other houses. The Board of <br />Health would have to impose only a one bedroom home on each lot unless other <br />arrangements and septic designs are put into place. The Board also discusses putting an <br />envelope on the lot showing where the house would go and possibly going back to the old <br />setback requirements. The Board would like to see what the other setbacks are on other <br />residences across the street and next door. Attorney Garner agrees to have this checked <br />out and asks for a continuance in order to get this done. The Board agrees to continue the <br />matter until December 13, 2006. <br />Carlos Nascimento: Requests a Variance from Section 174-31 of the Zoning By-laws in <br />order to seek relief from setback requirements on property located in an R-5 zoning <br />district at 15 Attaquin Street (Map 22 Parcel 0) Mashpee, MA. <br />AND <br />Carlos Nascimento: Requests a Special Permit from Section 174-45.4 of the Zoning <br />By-laws in order to build an accessory apartment on property located in an R-5 zoning <br />district at 15 Attaquin Street (Map 22 Parcel 0) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Frederick Bergeson, Marshall Brem, and <br />• lonathan Forbush. <br />Stephen LaLiberte of Cape Style Builders represents the applicants at this hearing. They <br />are seeking a special permit to build an accessory apartment and a variance to seek relief <br />from the setback requirement of 25 feet on the side and 40 feet from the street. They are <br />proposing a garage with the accessory apartment above it. The house is currently. <br />restricted to 3 bedrooms which is what is has now so the builder would have to open up <br />one of the existing bedrooms to have a 6 foot opening and seal off the closet as the board <br />has requested before when it is necessary to reduce an existing bedroom. Applicant is <br />looking forjust under 15 feet on the northwesterly side for the variance request. There is <br />some opposition from abutters John Ellis oI'5 Autumn Drive and Tom Perry of 6 Autumn <br />Drive. They feel strongly that the proposed garage is too close to the side line for a lot <br />just over 10,000 square feet. They discuss the parking dangers since the existing <br />driveway is such a steep hill and feel a two car garage is too over -powering for the lot <br />and the neighborhood. They discuss other areas to put the garage however, Mr. <br />LaLiberte mentions there is the septic system to consider. They discuss going to a one <br />car garage however this is not what his customer is looking for. "file Board tends to agree <br />with the abutters and is also not happy with the parking situation. Atter much discussion <br />regarding parking and lack thereof, the Mr. Nelson asks for a vote. Zella Elizenberry <br />wishes to abstain from the voting. Robert Nelson denies the both motions. Jonathan <br />Furbush denies both motions. Frederick Borgeson denies both motions. Marshall Brem <br />denies both motions. This is all denied without prejudice.
