4. The Board finds that construction must include applicable noise attenuation <br /> standards in order to adequately protect residents from potentially damaging noise <br /> pollution. <br /> 5. The Board finds that Project's stormwater management system is likely feasible <br /> but requires further review following issuance of this permit, as detailed in <br /> Section IV hereof. The Board also finds that enhanced security may be required <br /> for the bio-retention components of the stormwater management system. <br /> 6. The Board finds that an erosion control plan is necessary as part of the Final Plans <br /> to be submitted following the issuance of this Permit. <br /> 7. The Board finds that a phasing plan will mitigate impacts to local concerns. <br /> 8. The Board finds that it does not possess the requisite jurisdiction to divide the <br /> Property from the larger, presently undivided parcel. <br /> 9. The Board finds that the proposed open space to the rear of the Property—beyond <br /> the Limit of clearing as shown on the Plans—should remain open space, in <br /> perpetuity, under a suitable recorded restriction. <br /> 10. The Board finds that the grant of certain waivers from local by-laws and <br /> regulations, as described more fully in Section IV hereof, is acceptable although <br /> j the grant of any waivers may cause adverse impacts to local concerns. <br /> Nevertheless, the Board finds that the local concerns that have been affected <br /> thereby do not outweigh the Town's need for affordable housing, especially given <br /> the mitigation that has been provided by the Applicant. <br /> 11. The Board finds that the conditions imposed in the following section are <br /> necessary in order to properly address local concerns. The Board finds that such <br /> conditions will not render the project uneconomic. To the extent that such <br /> conditions do render the project uneconomic, the Board finds that the local <br /> concerns in imposing the same outweigh the potential benefits of the affordable <br /> units that have been proposed. <br /> IV. DECISION AND CONDITIONS <br /> Upon Motion of Fred Borgeson, seconded by Robert Nelson, the Board <br /> unanimously voted to grant a Comprehensive Permit to the Applicant for the proposed <br /> project, subject to the following conditions: <br /> 1. Except as otherwise required by the conditions imposed by this <br /> Comprehensive Permit or by the Final Site Plans as referenced below, the <br /> project shall be developed, constructed and completed in conformance with the <br /> Plans, as revised during the public hearing. <br /> Mashpee Woods-final pennit—6/12/08 5 <br />
