required. The Applicant agreed to submit to such further review subsequent to the <br /> close of the hearing and the issuance of the Comprehensive Permit. <br /> 9. The Applicant proposes a public water source via the Mashpee Water District, <br /> over which the Board has no jurisdiction. Based upon correspondence between <br /> the Applicant and the Water District, it appears that a public water source is likely <br /> available but the District has yet to commit to providing such a connection. <br /> 10. The Project will be served a private wastewater disposal facility that requires <br /> approval from the Massachusetts Department of Environmental Protection. <br /> 11. The Applicant has pledged to implement Low Impact Development (LID) <br /> standards <br /> 12. As shown on the Plans,the five buildings in the Project will be served by 246 <br /> parking spaces. <br /> 13. On the May 11, 2007 Plans (Sheet 9), the Applicant proposes four phases for the <br /> construction of the development. <br /> 14. The Applicant has submitted a limited list of requested waivers, dated April 11, <br /> 2007 from local by-laws and regulations. A discussion of waiver requests is <br /> included in Section IV hereof. <br /> 111. FINDINGS <br /> 1. The Board finds that the Town has a continuing need for affordable housing and <br /> that this project will provide such housing. The Board also finds that, due to the <br /> modest design of the Project, the market rate units will also be affordable to <br /> middle income Cape residents. The Board therefore finds that an approval may <br /> be warranted despite the fact that recent progress toward the creation of affordable <br /> housing may entitle the Board to reject the Application. <br /> 2. The Board finds that, with the addition of a second means of access to Echo Road, <br /> along with eiilianced on-site emergency access, the Project will provide safe and <br /> expedient access for emergency vehicles. <br /> 3. The Board finds that the proposed residential uses are not necessarily compatible <br /> with the existing and proposed commercial/industrial uses. However, the Board <br /> finds that, when built in accordance with the Plans and the conditions imposed <br /> herein, the project is "consistent with local needs" as such phrase is contemplated <br /> under G.L. c. 40B, 5§20-23.
