Zoning Board <br />Of Appeals Minutes <br />• 5 January 12, 2005 <br />David Sanicki of Cape & Islands Engineering represents the petitioner at this hearing. <br />They are seeking a special permit to install a pier, ramp and float and a variance to <br />exceed the 70 -foot maximum length allowed. The water depth is not enough and they <br />must extend the length of the dock by 16 feet in order to achieve the depth they need. <br />They also need to shorten the float for these same reasons. Robert Nelson moves to grant <br />the special permit and a I6 -foot variance. Richard Guerrera seconds the motion. All <br />agree. So moved. <br />Marc DeNardo: Requests a Variance from Section 174-31 of the Zoning By-laws in <br />order to seek relief from the setback requirements to build a 14'x 18' addition and a 34' <br />7' addition on property located in an R-5 zoning district at 17 Wilann Road (Map 46 <br />Parcel 43) Mashpee, MA. <br />Marc DeNardo: Requests a Special Permit from Section 174-45.4 of the Zoning By- <br />laws to build an accessory apartment above a garage on property located in an R-5 zoning <br />district at 17 Wilann Road (Map 46 Parcel 43) Mashpee, MA. <br />Sitting: James Regan, Robert Nelson, Zella Elizenberry, Richard Guerrera and Evano <br />Cunha. <br />Mark DeNardo represents himself at this hearing. Lori Corsi informs the Board that the <br />• wording of the advertisement was incorrect, as it did not mention the correct dimensions <br />of the garage to be built with the apartment above it. Kathleen Bailey, direct abutter <br />visiting the ZBA office in dire opposition of the proposal. She was unavailable to attend <br />the hearing but wanted her opinion voiced. Mr. DeNardo believed everything was in <br />agreement with the Bailey's since he had previously spoken with her husband and he did <br />not have a problem with the project. Mr. Nelson suggested that since this needs to be re - <br />advertised anyway, the Board deny both matters and have the applicant begin again. <br />They agree to a February 23, 2005 date. Mr. Nelson moves to deny the special permit <br />and variance request without prejudice. Zella Elizenberry seconds the motion. All agree. <br />So moved. The matter will be re -advertised and heard again on February 23, 2005. <br />Herbert and Christine Bader: Request a Variance from Section 174-31 of the Zoning <br />By-laws to seek relief from the setback requirements in order to build a deck, small <br />addition and a wood patio on property located in an R-5 zoning district at 48 James Circle <br />(Map 71 Parcel 34) Mashpee, MA. <br />Sitting: James Regan, Robert Nelson, Zella Elizenberry, Richard Guerrera and Jonathan <br />Furbush. <br />David Sanicki of Cape & Islands Engineering represents the petitioners at this hearing. <br />They are seeking a variance from the setback requirements, frontage and landspace in <br />order to expand their living area and build a wood patio and a deck. The Board would <br />like to seethe word "wood" patio deleted and just a patio put in. The applicant agrees to <br />is <br />this. The lot was created in 1969 and complied with zoning at that time. The new zoning <br />puts them out of compliance since they need 80,000 square feet of land and must <br />maintain 25 -foot setbacks on either side. Zella Elizenberry moves to grant the following <br />variances: a 66,650 square foot landspace variance, a 75 foot frontage variance, a 12 -foot <br />
