Zoning Board <br />Of Appeals Minutes <br />• 6 January 12, 2005 <br />front yard setback variance and a 14 foot side yard variance. Robert Nelson seconds the <br />motion. All agree. So moved. <br />Carlton Hendricks: Requests a Variance from Section 174-31 of the Zoning By-laws to <br />seek relief from the setback requirements in order to build an addition on property located <br />in an R-5 zoning district at 12 Somerset Road (Map 16 Parcel 104) Mashpee, MA. <br />Sitting: James Regan, Robert Nelson, Zella Elizenberry, Richard Guerrera and Evano <br />Cunha. <br />Carlton Hendricks represents himself at this hearing. He is seeking a variance on the side <br />yard setback requirements in order to expand his house and build a new kitchen and deck. <br />The Board feels all paperwork is in order and Robert Nelson moves to grant a 10.6 -foot <br />variance on the easterly side. Zella Elizenberry seconds the motion. All agree. So <br />moved. <br />Joe Valle and Charles Rowlev: River H i I Weetinghouse Road, Chapter 40B. <br />Discussion regarding bond issuance. <br />Joe Valle, Developer of the Meetinghouse Road Chapter 40 B project is before the Board <br />to discuss posting a bond for some engineering and landscaping that will need to be <br />• completed. He would like to convey the homes in the next 2 weeks or so and needs the <br />occupancy permits to proceed. He has provided the board with the information and <br />quotes for the remaining items to be completed. They include raising the catch basin <br />frames and grates, topcoat pavement, loam and seed road shoulders, fencing and <br />corrective work valued at approximately $18,260. They discuss a reasonable time frame <br />for these items to be completed. Mr. Valle feels the fence, drainage and bounding should <br />be complete by July 1, 2005 and the asphalt done by October 31, 2005. Zella Elizenberry <br />makes a motion to have a $28,000 bond posted to complete the above referenced items. <br />Letter is attached hereto. Richard Guerrera seconds the motion. All agree. So moved. <br />Mr. Rowley mentions that the planning board uses a release form, which could be <br />tailored to the ZBA's specifications. Lori Corsi will meet with Mr. Valle and create <br />something for Mr. Valle to sign. <br />DCPC: <br />The Board discusses the radical move of the planning board to move this entire town into <br />a DCPC. The current draft of the nomination is full of flaws and removes the power of <br />the ZBA dramatically. The ZBA feels a town -wide DCPC is not the way to solve traffic <br />issues, growth problems and all of the other issues Mashpee is trying to get a handle on. <br />They believe a 5 -person board should not dictate the feelings of the whole town and it <br />should go to town meeting. Mr. Nelson suggests increasing the size of the planning <br />department to address these problems as they are stretched for manpower to <br />accommodate more work. Mr. Nelson states that there have been 42 reports filed since <br />• 1998 until now, will this just be the 43rd report that no one acts on? He further implores <br />the planning board to realize that this will push developers to choose the path of Chapter <br />40B's and then what will that do to the traffic, schools, growth density and the like? The <br />state must become involved if the rotary is to change or alter in anyway and since all the <br />
