Zoning Board <br />Of Appeals Minutes <br />• 7 January 12, 2005 <br />available money for the Cape is tied up in the Sagamore flyover project, it does not look <br />good for anything to help us out in that avenue. The letter virtually eliminates special <br />permits for tear downs which when previously granted by the ZBA gave the town new <br />septic systems which is a far cry from the cesspools currently in existence in some of the <br />older homes. This takes away the rights of the ZBA to grant variances and takes away <br />buildablity of vacant lots that some of the retirement community have purchased for their <br />nest eggs. Zella Elizenberry states that a town -wide DCPC is not necessary. Mr. Regan <br />feels the way the Planning Board is doing this is not in the spirit of communication and <br />cooperation as we attempted to have several months ago. The Board makes a formal <br />motion to oppose the town -wide DCPC. All a ree. So moved. Lori Corsi will draft a <br />letter to the Planning Board for the January 20" deadline and get input from the Board. <br />Mr. Regan asks that each board member individually write a letter expressing their <br />feelings on this matter. <br />Expiration of Terms for Board Members <br />Mr. Nelson discusses the fact that the way the by-laws were accepted last October, there <br />exists some problems regarding the expiration of the terms of the ZBA members. The <br />Town Clerk suggested that the ZBA be polled for their opinion an vote on this matter. <br />Mr. Nelson feels that due to the age of several of the members we should have it be a "2, <br />• 2, 1" whereby each member's term expires one at a time. Mr. Nelson votes yes, Zella <br />Elizenberry votes yes, Richard Guerrera votes yes, Evano Cunha votes yes, Jonathan <br />Furbush votes yes, and Mr. Nelson votes yes. This should be addressed at the next town <br />meeting to have that changed. <br />Mashnee Commons — Job's Fishing Road <br />Douglas Storrs and Buff Chase are present to informally discuss the upcoming filing of a <br />Chapter 40 B for Mashpee Commons that has been approved by the state. They present <br />the entire plan to the Board and page by page discuss in detail each phase and the types of <br />houses they will be proposing to build. A set of the plans will be put in the Town Clerk's <br />office for anyone interested in looking at them. They feel that this particular area is an <br />excellent spot for housing of all kinds. They will offer a live/work situation, single- <br />family homes, townhouse situations and senior housing as well as the traditional <br />condominium type home. They will be following a traditional type look and would like <br />to create an historic setting for the town. Buff Chase and Doug Storrs would also like to <br />create a possible sub -committee that would be able to report directly to the ZBA so that <br />the lengthy meetings that go on quite late at night can be removed. This project is <br />proposed in phases as layed out in the booklet of plans. They are hoping by keeping all <br />of the neighbors and town boards informed on an informal basis before they open up the <br />public hearing and file with the ZBA formally, the Board will have a feel for what they <br />are trying to accomplish and offer the town. <br />0 <br />
