• 0 120 Town of Mashpee 16 Great Neck &acl North Mashpee, Massachusetts 02649 MASHPEE ZONING BOARD OF APPEALS Decision for a Special Permit Merope Deluca Owner of Record: Peter Dobyns 30-32 Baker's Road Map 20 Parcel 5 SP -05-03 A Petition was filed on December 21, 2004 by Merope Deluca for a Special Permit under Sections 174-17 of the Zoning By-laws to allow for alterations and changes to a non- conforming structure by adding 2 rooms on property located in an R-5 zoning district at 30-32 Baker's Road (Map 20 Parcel 5) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on December 31, 2004 and January 7, 2005, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, January 12, 2005, at which time the following members of the. Zoning Board of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson, Zella E. Elizenberry, Richard Guerrera and Evano Cunha. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of Mashpee Zoning By-laws. Merope Deluca represented herself at this hearing. She is seeking a special permit in order to build one additional room which will be a den and turn one of the existing- bedrooms xistingbedrooms into an office. There are 3 dwellings on the parcel of land that contains 4.2 acres. Due to a previous violation (SP -01-1 14) at this property whereby petitioner completed renovations without obtaining a building permit first, it is required of her to go through the Board of Appeals for any renovations done to this property. There will be a new septic system installed
