• _1 <br />Mashpee Zoning <br />Board of Appeals Minutes <br />2 February 9, 2005 <br />• district at 19 Sand Dollar Lane (Map 105/91 Parcel 51) Mashpee, MA. Owner: Stanley - <br />Evans Realtv Trust <br />Sitting: Robert Nelson, Zella Elizenberry, Richard Guerrera , Frederick Borgeson, Evano <br />Cunha and Jonathan Furbush. <br />Timothy Luff of Archi-Tect Associates represents the petitioners at this hearing. They <br />are seeking a special permit to demolish the existing dwelling and rebuild a new <br />dwelling, which will require setback relief and lot coverage relief. Robert Nelson <br />questions Mr. Luff about why they need to go beyond the 20% lot coverage and are <br />requesting 23.4% Mr. Luff says the proposed dwelling is not that big and they would like <br />to take advantage of the water view with the deck. Frederick Borgeson states that the <br />Board decided a while back that unless there is a dire circumstance, they would not be <br />issuing any lot coverage variances. He further states that most of the engineers and <br />architects know about this decision and should not come before the board with lot <br />coverage variances. Mr. Luff hands the Board another set of plans that shows the lot <br />coverage reduced somewhat but still at 21.7%. The Board tells him they need to get it to <br />20% or less and will not accept the 21.7%. It is decided that they will continue the matter <br />until February 23, 2005. Petitioner is acceptable to this and the Board moves to continue <br />this matter until February 23, 2005. So moved. <br />Kevin Caver: Requests a Special Permit from Section 174-25 G (4 and 5) of the zoning <br />• by-laws in order to manufacture and repair counter tops on property located in an 1-1 <br />zoning district at 78 Industrial Drive (Map 88 Parcel 33) Mashpee, MA. Owner of <br />Record: Paul Deruvter, Trust, Mashpee Industrial Park Trust. <br />Sitting: Robert Nelson, Zella Elizenberry, Richard Guerrera, Frederick Borgeson, Evano <br />Cunha and Jonathan Furbush. <br />John Slavinsky of Cape & Islands Engineering represents the petitioner. He is seeking a <br />special permit to add the use of manufacturing and repairing countertops to the building <br />he is interested in erecting. He has been through Plan Review who had comments that <br />included the following: (1) change the drainage; (2) all parking needs to be curbed: (3) <br />fire department wants access to two sides of the building and they made it three; (4) and <br />sprinkler the entire building where there is an agreement with the owner and the Town of <br />Mashpee. They will install a denitrification system, which is a positive item for the town. <br />The Board feels this is what the industrial zone was designed for and that the granting of <br />this permit would be appropriate. Frederick Borgeson moves to grant the special permit. <br />Richard Guerrera seconds the motion. All agree. So moved.
