i-'. <br />• <br />Mashpee Zoning <br />Board of Appeals Minutes <br />1 March 9, 2005 <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes - Wednesday, March 9, 2005 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, March 9, <br />2005 at 7:00 p.m. at the Mashpee Town Hall. Board Members Robert Nelson, Frederick <br />Borgeson and Richard Guerrera were present along with alternate member Jonathan <br />Furbush. Members Marshall Brem and Zella Elizenberry were absent. Alternate <br />Member Evano Cunha was also absent. <br />Mr. Nelson brought the meeting to order at 7:10 p.m. <br />Mr. Nelson had Mr. Guerrera read the last minute continuances that were to take place <br />this evening. <br />Couto Management Group, LLC: Requests a Special Permit from Sections 174-17, <br />174-24 and 174-25(e)(1) and (2) of the Zoning By-laws in order to alter a pre-existing <br />• non -conforming structure, to raze and replace with proposed building to allow for <br />commercial use of property under 10,000 square feet of combined floor space on less <br />than 10 acres in the C-2 district; and use for retail and restaurant to construct a single <br />story building consisting of a Dunkin Donuts restaurant with a drive through window and <br />five additional retail units on property located in a C-2 zoning district at 6 Falmouth <br />Road/Rte 28 (Map 55 Parcel 7) Mashpee, MA. Owner: Marion Augusta <br />Mr. Nelson informed Couto Management that due to one of the Members being in the <br />hospital, they do not have a quorum in order to hear the petition. Zella Elizenberry was <br />one of the original members present and acting when Couto Management first presented <br />their application. Since she is absent, they must continue the matter until the next <br />available hearing. Since the ZBA is having an attendance problem for various reasons at <br />the moment, Mr. Nelson suggested to Attorney Ford that they consider re- filing in order <br />to have the new members available to sit on the matter since they cannot assume Ms. <br />Elizenberry will be back by the next hearing. Attorney Ford wishes to continue the <br />matter until March 23, 2005 and see what happens at that point. The Board agrees. Thus <br />the watter is continued until March 23, 2005. <br />Lisa Drake: Requests a Special Permit from Sections 174-17 and 174-20 of the Zoning <br />By-laws to alter a pre-existing non -conforming structure and demolish and rebuild a new <br />dwelling on two lots to be combined on property located in an R-3 zoning district at 413 <br />Monomoscoy Road (Map 124 Parcel 60) Mashpee, MA. <br />• Lisa Drake: Requests a Special Permit from Sections 174-17 and 174-20 of the Zoning <br />By-laws to alter a pre-existing non -conforming structure and demolish and rebuild a new <br />• <br />• <br />
