Mashpee Zoning <br />Board of Appeals Minutes <br />2 March 9, 2005 • <br />• dwelling on two lots to be combined on property located in an R-3 zoning district at 417 <br />Monomoscoy Road (Map 124 Parcel 59) Mashpee, MA. <br />Lisa Drake: Requests a Variance under Section 174-31 of the Zoning By-laws to vary <br />the setback requirements in order to build a new 5 bedroom dwelling on property located <br />in an R-3 zoning district at 417 Monomoscoy Road (Map 124 Parcels 59 and 60 to be <br />combined) Mashpee, MA. <br />Attorney Theodore Schilling represents the petitioner at this hearing. Mr. Nelson inform: <br />Attorney Schilling that he has right to postpone the matter due to the fact that there are <br />only four members and not a full 5 -person board tonight. He explains that all four <br />members would need to vote favorably in order for his petition to pass thus decreasing <br />his chances for an approval by one person. Attorney Schilling does not wish to present <br />more headaches for the Board, however, since his client is home sick he is unable to <br />confer with him and would like to exercise his rights to have a full person board for his <br />petition. The Board understands and moves to continue this matter until March 23, 2005. <br />Present: Robert Nelson, Richard Guerrera, Frederick Borgeson and Jonathan Furbush. <br />(HEARING NOT OPENED) <br />Marianne Townsend, Trustee of the MMT Revocable Trust: Requests a Special <br />Permit under Section 174-17 and 174-20 of the Zoning By-laws to alter a pre-existing • <br />• non -conforming structure and remove and reconstruct a new 4 bedroom dwelling on <br />property located in an R-3 zoning district at 16 Deans Hollow Road (Map 117 Parcel <br />386) Mashpee, MA. <br />Attorney Kevin Kirrane represents the petitioner at this hearing. Attorney Kirrane would <br />also like to exercise his rights and wait until there is a full 5 -person board available to <br />him. The Board understands and agrees to continue the matter until March 23, 2005. <br />Present: Robert Nelson, Richard Guerrera, Frederick Borgeson and Jonathan Furbush. <br />(HEARING NOT OPENED) <br />CB&G Realtv Trust 11: Requests a Variance from Section 174-31 of the Zoning By- <br />laws seeking relief from setback requirements and landspace requirements in order to <br />allow for the construction of an addition to a commercial building on property located in <br />a C-1 zoning district at 33 Great Neck Road, South (Map 74 Parcel 14B) Mashpee, MA. <br />Owner of Record: Julie Hardiean, Trustee <br />CB&G Realtv Trust 11: Requests a Special Permit from Sections 174-17, 174-24, 174- <br />25 (D)(1) and (2) and 174-51(8) of the Zoning By-laws in order to construct an addition <br />to a commercial building on property located in a C-1 zoning district at 33 Great Neck <br />Road, South (Map 74 Parcel 14B) Mashpee, MA.
