Mashpee Zoning <br />Board of Appeals Minutes <br />• 1 August 10, 2005 <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, August 10, 2005 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, August 10, <br />2005 at 7:00 p.m. at the Mashpee Town Hall. Board Members Robert Nelson, Zella <br />Elizenberry, Marshall Brem and Evano Cunha were present along with alternate members <br />Jonathan Furbush., James Reiffarth and Eric Dublirer. Board member Frederick <br />Borgeson was absent. <br />Mr. Nelson brought the meeting to order at 7:00 p.m. <br />Mrs. Littleford-Jordan has asked for an informal discussion with the Board to see how <br />they should go about getting the land that they have (23 acres) and a roadway that has <br />been partially taken by the town - how should they resolve this matter? They have <br />spoken with the Town Planner and he suggested that they come to the ZBA. After a few <br />moments of reviewing the subdivision plan the Board is of the opinion that they need to <br />• obtain legal counsel to secure.their best interests. There is a lot of research that needs to <br />finished be done and roads that need to be either built or and a presentation needs to be <br />given to the board so they can then determine what the appropriate action would be. Mrs. <br />Jordan tells the Board that they live in Maryland and it is difficult for them to do this. <br />Ms. Elizenberry tells them that this would be the best way to go and the rest of the Board <br />agrees. <br />Southside Realtv Trust - McShane Construction Request for <br />Minor Modification for Main Street Village to change two "Quadplex" <br />buildings originally on lot #9 to four duplex buildings of similar floor plan, <br />size and layout. <br />Attorney Kevin Kirrane presents his clients interest in this informal request by McShane <br />Construction. The Board previously granted a comprehensive permit as well as a <br />modification of the comprehensive permit in 2004. They were given the permit for 16 <br />detached units and on 2 lots 8 attached units. (two 4 unit two story buildings) (aka <br />"quadplexes") They are asking to change these quadplexes over to single story duplexes. <br />Attorney Kirrane says there will be no floor plan changes and it will still remain the same <br />number of units. The reason is because of marketing — they feel the duplexes will <br />basically sell better. Zella Elizenberry mentions that the presentation that was given to <br />the affordable housing committee was far different than what is being presented this <br />evening. Mr. Kirrane was not present at that meeting and does not know what was <br />• presented as his client is not here tonight. Furthermore, Ms. Elizenberry asks if the <br />lottery winners for these houses were informed of these proposed changes? Attorney <br />Kirrane does not know. Mr. Nelson mentions that he feels they should have a say in this <br />since they put in for a certain type of building and now the builder wants to change it <br />without their consent or approval.
