Mashpee Zoning
Board of Appeals Minutes
• 2 August 10, 2005
productive to have their approval on this matter before tonights hearing. The Board feels
this is not a minor change and indeed they will need counsel to approve this and feel it is
a major change. The feel it changes the look of the whole subdivision and the lottery
winners of those units need to be included in this change if it happens at all. Attorney
Kirrane will speak to his client to see how they wish to proceed with respect to filing
more paperwork on this permit. They will to continue this matter until August 24, 2005.
So moved.
Dry Harbor Enterprises: Requests a Special Permit from Sections 174-25 (6)
and 174-25 (9) of the Zoning By -Laws in order to have a boat storage
facility indoor and outdoor on property located in an I-1, R-3 and C -I zoning
district at Lot 1A Wags Road (Map 81 Parcel 6) Mashpee, MA. Owner of
Record: Shirley A. Ford
Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Jonathan Furbush and Eric
Dublirer.
Attorney Kevin Kirrane represents the applicant Andrew Conway, who is also present.
This matter was continued from July 27, 2005 so that the Board could digest the plans
and meet with the police department for input on a "right in / right out" only entryway to
• the property. Mr. Nelson begins with a question to Attorney Kirrane about how many
businesses will actually be in the property. Andrew Conway, the owner, tells them right
now there are two but they could have as many as three. Mr. Nelson who also sits on the
Design Review Committee states that they were under the impression that there was
going to be one business. Mr.Conway informs him that indeed he will be the owner but
will have "2 arms" of the business — there is adequate parking for all proposed companies
and employees. Mr. Conway mentions that right now there is a marine repair company
and a boat hauler that will take up residence if the permit is granted. Eric Dublirer asks if
these businesses can bring in "other businesses". Mr. Conway says that it will only be
wholesale boat repair and storage. The board again brings up their concerns on traffic
going in and out of the project. They feel that a large boat hauler on Falmouth Road will
have a detrimental impact on the area and begin a discussion on "right in/right out".
Attorney Kirrane feels this will not lessen the traffic issue. Mr. Nelson discusses the fact
that a representative from Nstar told him that the land inside the easement could only be
used for agriculture at this point. Mr. Conway informs the Board that he is in optimistic
discussions with Nstar and they are working things out at the moment. They know that
all of this is subject to approval from Nstar and the project will fold without it.
Mr.Nelson mentions that relocating the utility pole seems unreasonable since this
easement is the backbone of the power for the cape. Mr. Conway says that the pole may
end up staying but they are working toward a fruitful conclusion. The Board addresses
the letter that Police Chief Rodney Collins submitted summarizing the meeting he had
with Bob Nelson regarding the traffic issues. Chief Collins is in full agreement that there
shall be a "right in — right out" form of egress constructed to enter the proposed facility.
• The reasons for the recommendation are as follows:
The volume of traffic on Route 28 at the intersection of Wag's Road
Speed of traffic in the vicinity at the intersection of Route 28 and Wag's Road
