Mashpee Zoning <br />Board of Appeals Minutes <br />• 3 August 10, 2005 <br />• The likelihood of tractors and/or trucks entering and exiting with trailers and <br />extended loads. <br />• The likelihood of tractors and/or trucks entering and exiting with trailers and <br />extended loads having the inability for rapid acceleration to maneuver within said <br />intersection. <br />• The potential for accidents as a result of tractors and/or trucks entering and <br />exiting with trailers and extended loads having the size and width that could <br />obscure vision/sight distance and by blocking a travel portion of the roadway in <br />an attempt to tum. <br />• The environmental concern and potential explosive situation due to the likelihood <br />of full tanks of gasoline on boats being stored at such a facility. <br />This recommended traffic control regulation would result in northbound traffic on <br />Route 28 being able to turn right onto Wag's Road. In addition, southbound traffic on <br />Route 28 would be prohibited from turning left onto Wag's Road. Vehicles leaving <br />Wag's Road would be permitted to only turn right onto Route 28. Any and all vehicles <br />entering and/or exiting Wag's Road will not face an unreasonable hardship as a result of <br />utilizing the Industrial Road which will enable them to proceed onto Route 28 via a <br />traffic light and thus enhance safety of the motoring public. <br />• Attorney Kirrane feels this is extensive and that the Commonwealth of <br />Massachusetts should have the final say about this since they already issued them a curb <br />cut. He also states that this will not help with the traffic at all and should not be imposed <br />as such. Mr. Conway submitted pictures of the sight distance to the Planning Board and <br />they felt it was acceptable. Mr. Nelson informs Attorney Kirrane that it is not the volume <br />of traffic but the kind of traffic — pulling trailers would be problematic for safety issues. <br />The Board feels all of the recommendations that Chief Collins has made shall be <br />conditioned on the Special Permit. Also conditioned on the Special Permit are all the <br />necessary permits from Nstar and all of the requests from the Fire Department being met. <br />That being said, Marshall Brem moves to grant the special permit with the above- <br />mentioned conditions. Zella Elizenberry seconds the motion. Robert Nelson votes to <br />deny. Eric Dublirer votes in favor. Jonathan Furbush votes in favor. Motion is carried <br />4-1. Marshall Brem makes a motion to have the applicant post a $25,000 landscaping <br />bond. Zella Elizenberry seconds that motion. All agree. So moved. <br />Scott Wurster: Requests a Variance from Section 174-31 of the Zoning By- <br />laws to exceed the maximum allowable 20% lot coverage to build an <br />addition on property located in an R-3 zoning district at 4 Bayview Road <br />(Map 119 Parcel 32) Mashpee, MA. <br />Sitting: Robert Nelson, Zella-Elizenberry, Marshall Brem, James Reiffarth and Evano <br />• Cunha. <br />Scott Wurster represents himself at this hearing. He is again before the board with plans <br />to tear down a small cottage and rebuild a new dwelling on a 4,300 square foot lot.
