Mashpee Zoning <br />Board of Appeals Minutes <br />3 August 24, 2005 <br />• stipulations. Evano Cunha seconds the motion. All agree. So moved Reference plans <br />from Cape & Islands Engineering, dated April 15, 2005, architectural plans dated January <br />16, 2005 and landscaping plans approved by Design Review Committee. <br />Robert J. Conwav: Requests a Variance under Section 174-31 of the Zoning By-laws to <br />seek relief from the setback requirements in order to build a detached 12' x 20' garage on <br />property located in an R-5 zoning district at 8 Alma Road (Map I 1 1 Parcel 198) <br />Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Evano Cunha and Eric <br />Dublirer. <br />Mr. Conway represents himself at this hearing. He is seeking a sideyard variance in <br />order to build a garage. They spend about 6 months of the year in Florida and would like <br />to leave one car here and need a garage to do so. Mr. Nelson reads a letter of opposition <br />from James Corbett, a direct abutter. He does not want this variance to be granted but <br />does not explain why. Mr. Brem mentions that he met Mr. Corbett upon his site <br />inspection at Mr. Conway's property. He informs the board that although Mr. Corbett <br />doesn't want any hard feelings between neighbors, he does not want the garage so close <br />to his property. Mr. Brem asks the applicant what his hardship is? Mr. Conway says that <br />if he built the garage anywhere else, a couple of beautiful trees would have to be removed <br />and they would not be able to enjoy their back yard as they do now. The Board discusses <br />• how close the applicant's garage would be to the abutter's property and some <br />compromising numbers. Mr. Brem feels this is not a necessary variance and does not feel <br />it should be granted. Mr. Dublirer feels that had the abutter not sent in a letter of <br />opposition, he would not have a problem with this. Mr. Nelson feels that if the matter was <br />of such importance to Mr. Corbett, he should have been here to explain why he was <br />against the matter. Further discussion ensues. They come up with 7 '/I feet instead of 5 <br />feet and Mr. Nelson makes a motion. Zella Elizenberry votes in favor. Evano Cunha <br />votes in favor. Eric Dublirer votes to deny the motion. Marshall Brem votes to deny the <br />motion. The matter is denied with a 3-2 vote. Plans referenced for this hearing are from <br />Cape & Islands Engineering, dated August 2, 2002 and revised July 21, 2005 and <br />architectural plans from Custom Home Designs of Mashpee, MA. <br />OTHER BUSINESS: <br />Blue Ribbon Committee: Mr. Nelson reads a letter he received from Joyce Mason <br />regarding a committee that the Board of Selectmen has decided to set up. They are <br />requesting one representative from the ZBA to be involved in this to address critical <br />issues affecting the Town as a result of rapid growth and development. Zella Elizenberry <br />has volunteered to be the designated person from the ZBA and Mr. Nelson says that he <br />feels there is no one better for this job than Zella. Lori Corsi will let Joyce Mason know <br />whom the Board has chosen. <br />Harwich Concrete: Mr. Brem has brought this matter to the Board's attention again since <br />• there are still some loose ends that have not been completed.
