Dougherty,192 NinigretAve. Proposed permitting of existing seasonal dock. RDA <br /> Homeowners Dale and Deborah Dougherty presented plans. <br /> Agent said there's not much more to add, the purpose is to get the existing structure on <br /> record. Town staff is familiar with it, State and National Heritage weighed in on it already. We <br /> recommend the most expediate way to get this into compliance is to recommend an RDA. He <br /> verified the measurements the Assistant Agent took with the Homeowner and asked for a <br /> revised plan that reflects the accurate measurements. He also asked that the exposed <br /> Styrofoam be encapsulated. Chapter 91 will require a permit. No other comments. <br /> Ms. Zollo asked how we approve a dock and ramp not on their property. Dale Dougherty said <br /> there's a battle going on with that in land court right now. That road has already been <br /> eliminated by the Town and they're charging us forwaterfront property. Not to mention the <br /> fact that the dock has been in existence for over 50 years. In the last few years some people <br /> have gotten the road eliminated from their property. Ms.Zollo said other properties have <br /> easements across it to access the pond. As far as what she can tell, they don't own the <br /> waterfront and are not paying taxes. Dale Dougherty said they are paying waterfront property <br /> taxes. Deborah Dougherty said they went to land court over this. And The courts said people <br /> behind us that have the right to those beaches have the right to cross that road but not to <br />
