transverse down it. I can bring documents from the land court. We also have a letter saying
that when a property is turned over the road should be eliminated. Since that has happened,
no one transversed over that road anymore. The road is actually on the sand. Dale
Dougherty said when he bought the property he had the land surveyed and found that road
was 8ft on his own personal property. Deborah Dougherty said people were driving on their
property by 8ft and she once almost got hit. They went to land court over this to shut it off.
Dale Dougherty said every property on that road has a dock.
Mr. Sweet motioned for a negative determination.
Mr. O'Neill seconded the motion.
Vote: 6-1-0
Roll Call Vote:
Mr.Weeden; yes
Mr.O'Neill; yes
Mr.Sweet; yes
Mr.Colombo; yes
Mr.Smith; yes
Mr. Dalton; yes
Ms. Zollo; no
In favor,6; Opposed, 1; Abstentions, 0
6:03 Flat Pond Homeowners Association, 3 Greatfield Landing (New Seabury Dunes Golf NOI-
Course) Proposed treatment and eradication of aquatic invasive species. Proposed installation of pool with associated NOI
hardscaping and mitigation plantings. Continued from 11118 for revised plans, narrative
Mike Coutu from Sudbury Design Group presented plans.
Agent said one aspect is that the hardscaping is proposed to go right to the top of the coastal
bank and is requesting the removal of a pitch pine. It was brought up in the initial review, and
there was a potential concern about the safety of the tree so Bartlett Tree Company did an
assessment. The outcome of the assessment rated it as 'moderate risk', which means it's not
justified. I don't consider it necessary, I would ask to look at a different configuration.
Mike Coutu said they've looked at alternative layouts, and spoke with Bartlett. The proximity
of the excavation to the pond would put the tree at further risk. Bartlett recommended not to
increase the risk. We looked at other layouts but they weren't feasible.
Agent asked about reducing the footprint, Mike Coutu said in order to be a therapeutic pool it
has to be a certain size. Assistant Agent asked about moving it more towards the north, Mike
