t016'y g,��y <br /> ( d4own of <br /> 16 Gr cat Neck load JAfi)r-th <br /> flash/)c>e, Nlassaclrusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Petition for Variance — Denied Without Prejudice <br /> RE: Tina Cavanaugh 7 Weather Crescent <br /> Map 83 Block 82 <br /> V-05-113 <br /> A Petition was filed on September 2, 2005 for a Variance from Section 174-31 of <br /> the Zoning By-laws for permission to vary the rearsetback requirements to install a built- <br /> in pool on property located in-an R-3 zoning district at 7 Weather Crescent (Map 83 <br /> Block 82) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 9, 2005 and <br /> September 16, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 28, 2005, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, James Reiffarth and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Steve Senna represents the applicant at this hearing. They are seeking a variance <br /> to the rear lot line to install a swimming pool The proposed pool on the plot plan shows <br /> that it would be 6.3 feet from the lot line. Mr. Senna states that they were forced to put it <br /> in that area due to the septic system and they are looking for a 9 foot variance. The <br /> Board reviews the plans and Mr. Nelson reads a letter from an abutter Susan Reed who <br /> resides at 268 Mashpee Neck Road. Her property abutts the applicant's in the rear and <br /> she feels this variance would infringe too closely. There is also a fence that was put up <br /> i <br /> and much debris was left on the Reed's property. The Board feels this is far too close to <br />
