3 <br /> Board finds that the Applicant's other revisions to the project roadway are responsive <br /> to their concerns for the safe passage of vehicles, including emergency vehicles. <br /> 2. The Board finds that the reports of its consulting engineer Charles Rowley provided <br /> comments and recommendations that address many of the Board's concerns regarding <br /> the use of the Property. The Board finds that Mr. Rowley's additional <br /> recommendations should be implemented by the Applicant when preparing the final <br /> plans for construction. <br /> 3. The Board finds that that the Project,which will provide more than the minimum <br /> amount of affordable housing units,will be beneficial to the Town of Mashpee. <br /> 4. The Town of Mashpee has not met the statutory minimum set forth in G.L. c. 40B, <br /> 20 pr_760 CMR 31.04, nor is there,evidence.that-affordable_.housing.is located-on.- -- <br /> sites comprising one and one-half percent or more of the total land area zoned for <br /> residential, commercial or industrial use. There is also no evidence that development <br /> of affordable units consistent with the Application, as amended would result in the <br /> commencement of construction of such housing on sites comprising more than three. <br /> tenths of one percent of such land area. <br /> 5. The Board finds that the conditions imposed in the following section are necessary in <br /> order to make properly address local concerns as previously stated herein. Based <br /> upon its analysis of the pro-forma, the Board finds that such conditions will not <br /> render the project uneconomic. To the extent that such conditions do render the <br /> project uneconomic, the Board finds that the local concerns in imposing the same <br /> outweighs the potential benefits of the affordable units that have been proposed. <br /> 6. The Board finds that the waivers that have been granted will adversely impact local <br /> concerns, but that the local concerns that have been affected thereby do not outweigh <br /> the Town's need for affordable housing. <br /> IV. DECISION AND CONDITIONS <br /> Upon Motion of Frederick Borgeson, seconded by Zella Elizenberry, the Board hereby <br /> grants the Applicant a so-called"Comprehensive Permit," as shown on the Plans, subject <br /> to the following conditions: <br /> 1. .This decision is limited to an approval for the 16 housing units shown on the Plans. <br /> Except as otherwise'conditioned hereby, the Project configuration and housing styles <br /> shall be those shown on the Plans. <br /> 2. The Applicant shall prepare final construction Plans for the review and approval by <br /> the Board's engineer. In preparing final construction plans, the Applicant must <br /> address the concerns and'recommendations of the Board's engineer, as noted in his <br /> reports of February 19, 2004, March 10, 2004 and March 24, 2004. Final <br /> construction plans must also be approved by any local inspectional official with <br /> oversight over the construction. of this project. <br />
