C. 40B, ��20-23 <br /> APPLICANT: Southside Realty Trust (the "Applicant") <br /> PROPERTY: Land off of Rte 130: Map 36, Parcels 47, 47A, 47B, 47C, 47D, <br /> 47E, 47F, including Lettie Lane (the "Property") <br /> DATE: October 26, 2005 <br /> On September 1, 2005, the Applicant submitted a "Request for Major Modification" to <br /> the Comprehensive Permit, originally issued on May 5, 2004 which permit is filed with <br /> the Barnstable County Registry of Deeds at Book 19110, Page 313. The original Permit <br /> was subsequently modified on October 8, 2004, which modification was recorded with <br /> the Barnstable Land Court Registry Document No. 986,676, dated November 23, 2004. <br /> The Applicant concedes that the proposed Modification is substantial and accordingly, <br /> with the Applicant's consent, the Board opened and held a public hearing on the same on <br /> September 28, 2005 and October 19, 2005. The hearing was closed on October 19, 2005. <br /> The Project presently consists of 24 units. Eight (8) of the proposed units were proposed <br /> to be contained in two "quad-plexes" in the northwestern portion of the site The <br /> proposed modification seeks to break those eight units into four (4) duplexes, as shown <br /> on the site plans the Horsely Witten Group, entitled",Duplex Site Plans, Main Street <br /> Village" dated October 6, 2005 and the proposed architectural plans of Stephen C. Hayes <br /> (collectively,the "Plans"). <br /> I. FINDINGS <br /> In review of the proposed modification, the Board made the following findings: <br /> 1. The Board finds that the proximity of the proposed duplexes substantially <br /> decreases the setbacks to the adjacent property to the west when compared to <br /> the prior plans. Therefore, the proposed units could be negatively affected by <br /> proposed development on the adjacent property. In plans given to the Board, <br /> tentative development proposals on the adjacent property would include <br /> parking facilities extending almost to the lot line. <br /> 2. The Board finds that the configuration and design of the four duplexes lack <br /> creativity and do not adhere to good design and planning principles. The <br /> architecture as well as the physical location of the four buildings should be <br /> varied to improve the design and configuration of the project. <br /> l <br />
