3. The Board finds that, based upon the reports of its engineer Charles Rowley, <br /> there are still certain issues to be resolved with respect to project <br /> infrastructure. <br /> 4. Subject to the conditions imposed herein, the Board finds that the proposed <br /> Modification enhances much needed affordable housing opportunities and that <br /> the benefits of such housing outweigh any local concerns impacted by the <br /> proj ect. <br /> DECISION AND CONDITIONS <br /> Upon Motion of Frederick Borgeson, seconded by James Reiffarth, the Board <br /> unanimously voted to grant the Applicant's request, subject to the following conditions: <br /> 1. Along the boundary with the adjoining property to the west, the Applicant <br /> shall maintain a thick vegetated buffer consisting of a variety of species, <br /> including evergreens. If the buffer area must be cleared to allow for <br /> construction, it must be replanted in a man ier to satisfy the conditions of this <br /> paragraph. During the hearing,the Applicant agreed with this condition. No <br /> occupancy permits may be granted for the four duplexes until the Board <br /> approves any such-replanting. <br /> 2. Prior to requesting building permits for the four duplexes,the Applicant shall <br /> provide the Board with revised plans, exhibiting varied architectural styles <br /> and physical locations of the four duplexes, so as to satisfy the concerns <br /> included in Finding No. 2, above. During the hearing, the Applicant agreed <br /> with this condition. No building permits shall be granted until the Board <br /> approves such revised plans in writing, such approval not be unreasonably <br /> withheld. <br /> 3. The Applicant shall work closely with the Board's engineer Charles Rowley <br /> to ensure that project infrastructure is completed in accordance with all <br /> applicable regulations and Best Management Practices. No occupancy <br /> permits for the four duplexes may be granted until the Applicant complies <br /> with all of the requirements of the Board's engineer. Compliance with such <br /> requirements shall be evidenced by written notice from the Board's engineer, <br /> provided to the Board and the Mashpee Building Inspector. <br /> 4. The Board hereby grants waivers from all dimensional requirements that are <br /> necessary to construct the proposed duplexes, as conditioned herein. Waivers <br /> are limited to the extent necessary to construct the project shown on the Plans <br /> as conditioned hereby. Waivers are further limited solely to the by-laws and <br /> regulations contemplated under G.L. c. 40B, §§20-23. No other waivers are <br /> granted and all local by-laws and regulations not waived shall be enforced in <br /> their entirety. There shall be no waiver of permit or inspectional fees.
